Description
Procurement of orthopaedic implants based on a framework agreement with the establishment of a consignment warehouse for the contracting authority. Abbreviations: Contracting Authority (CA); Tenderer (T); Subcontractor (SC); Procurement Documents (PD); Call for Competition (CfC), framework agreement (FA). The estimated total value of the FA is 21 351 696,- Ft net: base quantity related framework amount: 19 410 633,- Ft net; + 10% option related framework amount: 1 941 063,- Ft net. Based on the FA, the procurement (direct order) will be implemented according to point a) of paragraph (2) of section 105 of the Public Procurement Act. The CA wishes to conclude the FA with several Ts, with the CA's direct orders containing all the conditions of the FA. Based on the provisions of point a) of paragraph (2) of section 105 of the Public Procurement Act, the CA will send direct orders to the Ts in the order of their total score. Frequency of direct orders: The CA plans to issue direct orders on a weekly basis. Size of direct orders: The smallest direct order that can be issued by the CA: the quantity specified in the CfC. The largest direct order that can be issued by the CA: five times the quantity specified in the CfC. The CA complies with the obligation set out in point d) of paragraph (2) of section 50 of the Public Procurement Act by providing the framework amount and the estimated value. Based on the FA, the procurement will be implemented according to point a) of paragraph (2) of section 105 of the Public Procurement Act. If a valid tender is submitted in the first part of the framework agreement procedure and the FA is concluded with a T according to paragraph (1) of section 105 of the Public Procurement Act, the individual procurements will be implemented according to point a) of paragraph (1) of section 105 of the Public Procurement Act. Framework number: 3. If the number of tenders of the most favourable tenderers reaches the upper limit of the framework number, the CA will proceed according to paragraph (5) of section 77 of the Public Procurement Act, because the CA wishes to conclude the FA with a number of Ts not exceeding the upper limit of the framework number. Evaluation criterion: The CA evaluates the tenders according to point a) of paragraph (2) of section 76 of the Public Procurement Act - the lowest price - and selects the economically most advantageous tender for itself. In view of paragraph (5) of section 76 of the Public Procurement Act, the CA informs the Ts that the goods that meet the concrete quality and technical requirements defined as the subject of the procurement in accordance with the CA's needs, in addition to the selection of the economically most advantageous tender, is only served by the evaluation of the lowest price, considering that the goods are a standard product defined and circumscribed by law, and cannot be differentiated in terms of quality. In the interest of the unambiguous and generally understandable definition of the subject of the procurement, the CA may refer to the product, origin, type of thing, process, activity, person, or patent or trademark defined in the tender call and the procurement documents, according to paragraph (3) of section 46 of Government Decree 321/2015. (X. 30.). In every such case, the designation is made only in the interest of unambiguously defining the nature of the subject, and a tender can be made for a product prescribed in this tender call or for a product that is equivalent to it in terms of the detailed technical parameters relating to the given product. The CA must assess the equivalence during the technical content evaluation, for which the T must provide all the data. Therefore, the T must prove in the tender that the offered product is equivalent to the product defined by the CA. The CA will justify any non-acceptance in fact. The CA may also tender for a product with more favourable characteristics than prescribed. The detailed conditions, expectations are contained in the procurement documents.
