The subject of the contract is multi-sector investment supervision of construction works and conservation works within the project "Comprehensive Construction and Conservation Works at the Castle in Kwidzyn along with the adaptation for exhibition purposes of premises located in the adjacent new building” no. FENX.07.01-IP.04-0045/25 co-financed from the funds of the FEnIKS Programme and the state budget” – part no. 1. 2. The detailed description of the subject of the contract, i.e. the scope of the supervised works, is contained in: 1) the design documentation, which consists of: a) the construction project, i.e.: - Architectural and construction project - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. arch. B. Szubskiego, 2025, - Land development project - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. arch. B. Szubskiego, 2025, - Supplementary works - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. arch. B. Szubskiego, 2023, - Technical project. Architecture - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. arch. B. Szubskiego, 2023, - Technical and execution project. Structure - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. Ł. Dymura, 2023, - Technical project. Sanitary sector - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. G. Kalicki, 2023, - Technical project. Electrical and telecommunication sector - Renovation and adaptation of the Castle in Kwidzyn for the needs of the activity of MZM, by mgr inż. D. Naruszewicz, 2023, b) Technical Specifications for the Execution and Acceptance of Construction Works (hereinafter referred to as “STWiORB”), 2023: - construction sector, - electrical and telecommunication sector, - sanitary sector, 2) the programme of conservation works by P. Głuszko and M. Rogalewska, 2022, 3) the scope of works: - construction sector, - electrical and telecommunication sector, - sanitary sector, 4) the draft contract for construction and conservation works and the annexes to this contract, - which are available on the website of the ongoing procedure for construction works, i.e. https://platformazakupowa.pl/transakcja/1399107. 5) the draft contract for the aforementioned supervision, which is annex no. 1 to SWZ, 6) the detailed description of the subject of the contract (hereinafter referred to as the detailed description of the subject of the contract), which is annex no. 1 to the contract. 3. Equivalent solutions (if applicable): 1) in accordance with art. 101(4) of the Public Procurement Law [hereinafter referred to as the PZP Act], in the event that the description of the subject of the contract contains a reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, as referred to in art. 101(1)(2) and (3) of the PZP Act, and such references are not accompanied by the words “or equivalent”, it shall be understood that each: standard, European technical assessment, approval, technical specification, technical reference system appearing in the description of the subject of the contract is accompanied by the words “or equivalent", 2) wherever in the description of the subject of the contract, in particular in the design documentation, technical specification for the execution and acceptance of works, a trade name or trademark, patent or origin, source or special process is used, which characterizes the product or service provided by a specific Contractor, if the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner, such an indication shall be accompanied by the words “or equivalent”, 3) the indication of trade names in the design documentation or technical specification for the execution and acceptance of works shall be treated as exemplary names and serves only to specify the level of expectations of the Contracting Authority in relation to a specific product, material, device or solution. The use of trade names of producers/products/materials/devices is merely exemplary. By indicating a trade name in the description of the subject of the contract, the Contracting Authority also allows equivalent products with technical, operational, functional, quality and performance parameters at least at the level of the parameters indicated in the equivalence table, available at the procedure for construction works, i.e. at the address https://platformazakupowa.pl/transakcja/1399107. 4. The Contracting Authority divides the contract into parts in terms of the tasks provided for in the project, but does not divide it into smaller parts within a given task. The justification for not dividing the contract into parts of a given task is contained in Section III(6) of SWZ. 5. Persons participating in the opening of offers: members of the tender committee appointed by the Director's Order. 6. The Contracting Authority informs that: 1) it does not set requirements in terms of the employment of persons referred to in art. 96(2)(2) of the PZP Act, 2) it does not reserve that only Contractors referred to in art. 94 of the PZP Act may apply for the award of the contract, 3) it does not reserve the obligation of personal performance by the Contractor of key tasks, 4) it does not envisage the award of contracts referred to in art. 214(1)(7) of the PZP Act, 5) it does not envisage settlements in foreign currencies, 6) it does not envisage the reimbursement of the costs of participation in the procedure, including the reimbursement of the costs incurred in connection with the acquisition of a qualified electronic signature, 7) it does not envisage an electronic auction, 8) it does not envisage the submission of electronic catalogues, 9) it does not envisage the Contractor checking the documents necessary for the implementation of the contract, as referred to in art. 131(2)(2) of the PZP Act, 10) it will not use the reverse procedure regulated in art. 139(1) of the PZP Act, 11) the procedure is conducted in the Polish language. 7. The provisions of the Act of 5 August 2025 on the certification of contractors of public contracts also apply
