1. The subject of the contract is the successive delivery of instant meals to military units and training centre ranges in accordance with the assortment-quantity list contained in Section IV – "Description of the Contract" of the SWZ and in the "Offer Form" which is Annex 1 to the SWZ. 2. In accordance with Article 441(1) of the Pzp Act, the Contracting Authority envisages the possibility of exercising the "Option Right". The "Option Right" will be exercised on the same terms and conditions as the main contract. In the event that the Contractor does not exercise the "Option Right", with regard to the scope of undelivered supplies specified in the tables in Section IV of the SWZ, in the column named "quantity in option", no claims shall arise against the Contracting Authority, including in particular claims for payment of expected benefits. The "Option Right" means that the final quantity of the subject of the contract will depend on the current needs of the Contracting Authority. The Contracting Authority will inform the Contractor of its intention to exercise the "Option Right", together with the quantity of the subject of the contract and the place of its delivery, within the time limit specified in the "Draft Contract Clauses" which is Annex 5 to the SWZ. 3. The Contracting Authority does not allow the use of substitute packaging for food products that are the subject of the procedure during the execution of the contract. 4. The Contractor is obliged to inform the Contracting Authority in writing of any change in the occurrence of allergens in the delivered products. 5. The Contractor is responsible for ensuring the safety and proper hygiene of food products, with particular regard to the applicable legal provisions. 6. The Contracting Authority has described the subject of the contract by reference to standards. The Contracting Authority therefore indicates that it allows for solutions equivalent to the described standards.
