Winter maintenance of footpaths and county roads in Wołomin County in 2027, divided into parts. The subject of the contract is the winter maintenance of footpaths and county roads in the following municipalities:

Part 1 - footpaths and county roads in Poświętne Municipality

Part 2 - footpaths and county roads in Tłuszcz Municipality

Part 3 - footpaths and county roads in Dąbrówka Municipality

Part 4 - footpaths and county roads in Radzymin Municipality

Part 5 - footpaths and county roads in Jadów, Strachówka Municipality

Part 6 - footpaths and county roads in Marki, Ząbki, Zielonka Municipality

Part 7 - footpaths in Wołomin, Kobyłka, Klembów Municipality

II. Contract amendments:

Possible contract amendments:

1. Pursuant to Article 439(2)(2) of the Public Procurement Law (Pzp), the Contracting Authority envisages the possibility of changing the amount of remuneration due to the Contractor in the form of an Annex to the contract in the event of a change in costs related to the implementation of the contract by the Contractor, in accordance with the following rules:

1) the basis for determining the level of change in the price of materials or costs related to the implementation of the contract is the index of consumer goods and services prices published in the communication of the President of the Central Statistical Office, valid in the month in which the deadline for submitting offers expired;

2) the minimum level of change in the price of materials or costs calculated on the basis of the index of consumer goods and services prices indicated in point 1), entitling the parties to the contract to request a change in remuneration, is 10 percentage points;

3) the maximum value of the change in remuneration, which the Contracting Authority allows, is 15% of the net remuneration specified in § 3(1) of the Contract.

2. The amendments referred to in paragraph 1 above may only be introduced when they affect the costs of performing the contract by the Contractor. In the event of their occurrence, the Contractor may apply to the Contracting Authority in writing for a change in remuneration, submitting appropriate documents confirming the validity of such an application. The Contractor should prove beyond any doubt that the change has a direct impact on the costs of performing the contract and determine the extent to which it will affect the amount of remuneration. The Contractor may submit a written application for valuation no earlier than the day the regulations introducing the changes come into force.

3. The amendments referred to in paragraph 1 above may be introduced no more frequently than once every six months. The parties will be entitled to apply for the next change on condition that the index referred to in paragraph 1 point 1) changes by at least 10 percentage points compared to the month in which the previous change was made.

4. By changing the prices of materials or costs, as referred to in paragraph 1 above, we mean the increase in the prices or costs, as well as their decrease compared to the prices or costs accepted for the purpose of determining the remuneration included in the offer, therefore the entitlement to change the remuneration applies to both the Contractor and the Contracting Authority. In the event of a decrease in prices or costs compared to the prices or costs accepted for the purpose of determining the remuneration included in the offer, the provisions of paragraphs 2, 3 and 4 above shall apply accordingly to the Contracting Authority.

5. The Contracting Authority envisages, pursuant to Article 455(1)(a) of the Public Procurement Law (Pzp), the possibility of making changes to the provisions of this contract:

1) in the scope of changing the implementation deadline, if, due to favourable weather conditions, the planned financial resources will not be used in the planned period;

2) in the scope of increasing the amount, if very intense snowfall and frequent need to remove slipperiness on roads and footpaths will result in the planned resources being too small, an increase of up to 50% of the basic contract value at the prices specified in the offer is envisaged;

3) justified breaks in the implementation of works, arising from causes independent of and not the fault of the Contractor or the Contracting Authority;

4) change of § 31 in the event of the Contracting Authority developing better practices in the scope related to KSeF.

6. Contract amendments require written form, under pain of nullity, with the exception of cases directly indicated in the contract. Due to the limited number of characters, the Contracting Authority informs that:
