Poland – Ice-clearing services – Zimowe utrzymanie dróg wojewódzkich na terenie działania Rejonu Dróg Wojewódzkich w Koszalinie

The subject of the contract is the provision of winter maintenance services for regional roads managed by the Zachodniopomorski Zarząd Dróg Wojewódzkich in Koszalin within the area of the Koszalin Regional Roads Division, divided into 7 tasks: Task No. 1 - Biesiekierz; Task No. 2 - Koszalin; Task No. 3 - Darłowo; Task No. 4 - Sławno; Task No. 5 - Polanów; Task No. 6 - Bobolice; Task No. 7 - Szczecinek. The detailed location and scope of services for a given task are specified in Section C SWZ - Description of the subject of the contract and in the Price Forms (templates 4.1 – 4.7) SWZ. 2. The Contractor is obliged to implement the subject of the contract using ICT products, ICT services and ICT processes for which no recommendations have been issued, as mentioned in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of national security, or a decision or other act in connection with which a given ICT product, ICT service or specific ICT process should be withdrawn from use. 3. The Contracting Authority envisages the possibility of awarding similar contracts, i.e. contracts at will as referred to in Article 305(1) in connection with Article 214(1)(7) of the Act - Public Procurement Law. 1) The scope of the services consists in repeating similar services, consistent with the subject of the main contract; 2) The value of the services is set at a net amount of: Task No. 1 – 357 554,00 PLN; Task No. 2 – 1 838 004,00 PLN; Task No. 3 – 1 536 745,00 PLN; Task No. 4 – 1 384 723,00 PLN; Task No. 5 – 1 484 127,00 PLN; Task No. 6 – 1 830 602,00 PLN; Task No. 7 – 791 657,00 PLN. 3) The basis for determining the conditions for the implementation of a similar contract is the main agreement and negotiations conducted with the Contractor. 4. Pursuant to Article 95(1) of the Act - Public Procurement Law, the Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the following activities during the implementation of the contract, if their performance involves performing work in the manner specified in Article 22(1) of the Labour Code: 1) operation of equipment and vehicles used to provide winter road maintenance services, including activities performed by equipment operators and drivers. 2) manual performance of activities related to winter maintenance of pedestrian and pedestrian-cycling routes, in particular snow removal and removal of winter slipperiness. 5. This obligation also applies to Subcontractors. The Contractor is obliged to include in each subcontracting agreement the relevant provisions obliging Subcontractors to employ, on the basis of an employment relationship, all persons performing the above-mentioned activities.
