Poland – Refuse and waste related services – Odbiór i zagospodarowanie odpadów o kodzie 20 03 07 z Z/I Bełchatów, Z/I Dylów A, Z/I Julków, Z/I Gotartów i SP Ostrzeszów II /2026

1. The subject of this contract is the collection and disposal of waste with code 20 03 07, hereinafter referred to as the "subject of the contract". 2. The estimated quantity of waste to be collected and disposed of is 6 400 Mg over the contract period. 3. The waste that is the subject of this contract will be collected and then disposed of at the facilities indicated by the Contractor in a manner consistent with the applicable legal provisions and Annex 1 to the Waste Act. 4. The estimated quantities of waste to be collected and disposed of as part of the subject of the contract are as follows: - Task 1: Z/I Bełchatów, ul. Przemysłowa 14 and 16 - total quantity of waste to be collected during the contract period 1000 Mg; - Task 2: Z/I Bełchatów, ul. Przemysłowa 14 and 16 - total quantity of waste to be collected during the contract period 1000 Mg; - Task 3: Z/I Bełchatów, ul. Przemysłowa 14 and 16 - total quantity of waste to be collected during the contract period 500 Mg; - Task 4: Z/I Dylów, gm. Pajęczno - total quantity of waste to be collected during the contract period 1000 Mg; - Task 5: Z/I Dylów, gm. Pajęczno - total quantity of waste to be collected during the contract period 500 Mg; - Task 6: Z/I Julków, gm. Skierniewice - total quantity of waste to be collected during the contract period 600 Mg; - Task 7: Z/I Julków, gm. Skierniewice - total quantity of waste to be collected during the contract period 600 Mg; - Task 8: Z/I Gotartów, gm. Kluczbork - total quantity of waste to be collected during the contract period 600 Mg; - Task 9: Stacja Przeładunkowa Ostrzeszów, ul. Ceglarska 1a - total quantity of waste to be collected during the contract period 600 Mg. 5. Waste collection will take place from the premises of the Plant/Installation or Transshipment Station (hereinafter: Z/I or SP): Z/I in Bełchatów, ul. Przemysłowa 14 and 16, Z/I in Dylów A, gm. Pajęczno, Z/I in Julków, gm. Skierniewice, Z/I in Gotartów, gm. Kluczbork and SP in Ostrzeszów, ul. Ceglarska 1a. 6. Due to the unpredictable quantity of waste, the estimated quantity specified in paragraph 4 may change. Therefore, the Purchaser reserves the right to limit this quantity by a maximum of 90% during the execution of the contract. A reduction in the quantity of waste to this extent will not give rise to any claims on the part of the Contractor against the Purchaser, particularly for payment of remuneration for the unfulfilled part of the contract or for payment of compensation in connection with the reduction of the estimated quantity. In this situation, there is no need to prepare an annex. The Purchaser guarantees the Contractor a minimum of 10% of the estimated quantities of waste to be collected during the contract period. 7. The Contractor will use transport means to perform the service that is the subject of the contract at their own expense. 8. Loading of waste is the responsibility of the Purchaser. 9. The Contractor will ensure supervision of the loading activities and is obliged to provide adequate securing of the load during transport. The Contractor undertakes to transport the waste to the destination without endangering road traffic safety, exceeding the permissible vehicle weight or exceeding the permissible axle loads. 10. The scales installed in the Plants managed by the Purchaser have a current Certificate of Legalisation. 11. The Contractor undertakes to submit to the Purchaser a copy of the decision granting permission for waste processing (this applies to the decision that was changed during the contract period) immediately upon receipt, no later than 7 days from the date of receipt of the changed decision. This also applies to decisions of any subcontractors. 12. In the event of loss by the Contractor of the necessary permits, permits, concessions or other administrative decisions for conducting business activities, the Contractor will immediately notify the Purchaser, who in such a situation has the right to terminate the contract with immediate effect. 13. The waste that is the subject of the contract comes from the collection of bulky waste as part of agreements with municipalities, from external entities and also from PSZOKs. 14. The Contractor is obliged to ensure recovery in the recycling process for the separated waste with code 20 03 07. The minimum required recycling level is 40% by weight in relation to the total mass of collected waste classified under these codes. 15. The Contractor will submit to the Purchaser a declaration constituting Annex 3 to the contract, in accordance with the deadline for submitting an invoice specified in §4 paragraph 11, containing the following information: a) quantities of products or waste produced from them, indicating the final installation to which they were sent (name, BDO number along with MPD number) along with the final recovery (recycling) process to which they were subjected, including the quantities of waste subjected to the neutralisation process at the waste landfill; b) quantities of waste that have not undergone a processing process but have been stored and will be processed at a later date. The Purchaser requires that the waste be processed no later than 30 days from the end of the month in which it was collected. 16. Upon each request of the Purchaser, the Contractor is obliged to deliver within 7 days from the request – a collective summary of data, containing the quantities collected, processed and produced of waste with information on the processes to which they were subjected. 17. The waste referred to in the contract will be stored in bulk and will be loaded onto transport means in this form. On the date of signing the contract, the Contractor will submit to the Purchaser a signed declaration Annex 4 to the contract regarding the validity of the decision on waste processing.
