Poland – Household-refuse disposal services – ODBIÓR ODPADÓW KOMUNALNYCH POCHODZĄCYCH Z NIERUCHOMOŚCI ZAMIESZKAŁYCH Z TERENU GMINY SUŁKOWICE

The subject of this contract is the provision of a service for the collection of municipal waste generated on the premises of residential properties, holiday homes, and other properties used for recreational purposes within the Municipality of Sułkowice. The scope of work includes: 1. Collection of municipal waste directly from residential properties, holiday homes, and other properties used for recreational purposes, including: a) non-segregated (mixed) municipal waste, b) selectively collected waste, namely:  paper,  glass,  metals and plastics (including multi-material packaging),  bio-waste (in the absence of a declared composting facility),  ash and slag (in the case of solid fuel heating sources); c) bulky waste and used electrical and electronic equipment (upon prior notification). d) textile and clothing waste, 2. Acceptance at the Selective Municipal Waste Collection Point (PSZOK) of municipal waste delivered by the owners of residential properties, holiday homes, and other properties used for recreational purposes from the area of the Municipality of Sułkowice. The acceptance of waste must be carried out in accordance with the provisions of the Resolution of the Municipal Council of Sułkowice regarding the Regulations for maintaining order and cleanliness within the Municipality of Sułkowice and includes the following fractions: a) paper, b) metals and plastics, c) glass, d) hazardous waste, e) waste not qualifying as medical waste generated in households as a result of taking medicinal products in the form of injections and monitoring the level of substances in the blood, particularly needles and syringes, f) used batteries and accumulators, g) used electrical and electronic equipment, h) furniture and other bulky waste, i) used tires, j) construction and demolition waste, k) textile and clothing waste, l) bio-waste, m) ash and slag. 3. The quantity limit for municipal waste is 4800 Mg. 4. Transfer of waste collected from residential properties, holiday homes, and other properties used for recreational purposes, as well as municipal waste delivered directly by the owners of the aforementioned properties to the Selective Municipal Waste Collection Point, to the entity selected in the tender for the management of municipal waste, including transport from the area of the Municipality of Sułkowice. The subject of the contract does not include the collection and management of municipal waste generated in connection with conducted business activities (including agricultural). 5. The subject of the contract is described in detail in the Subject of the Contract Description (OPZ), which is an annex to this specification of contract conditions; 6. The Purchaser requires the employment, on the basis of an employment contract, by the Contractor or Subcontractor, of persons performing the following tasks during the execution of the contract: driving vehicles collecting waste and operators performing the loading and unloading of waste. 7. During the execution of the contract, the Purchaser is entitled to perform control activities regarding the Contractor's or Subcontractor's compliance with the requirement to employ, on the basis of an employment contract, persons performing the tasks indicated in point 6. 8. In particular, the Purchaser is entitled to: - requesting statements and documents regarding the confirmation of compliance with the above requirements and assessing them, - requesting explanations in case of doubts regarding the confirmation of compliance with the above requirements, - conducting on-site inspections of the service provision. 9. In the event of justified doubts regarding the Contractor's or Subcontractor's compliance with labor law, the Purchaser may request an inspection by the State Labor Inspectorate. 10. Classification of the contract according to the Common Procurement Vocabulary (CPV): 90513100 – 7 waste collection services from households; 90533000-2 – waste management services. 11. Division of the contract into parts: The Purchaser does not divide the contract into parts, each of which would constitute a separate subject of the contract. The scope and subject of the contract do not limit competition, dividing the contract into parts would be associated with coordinating the actions of different contractors implementing individual parts of the contract, which could seriously threaten the proper execution of the contract.
