Description

1. This procedure is conducted as an open tender in accordance with the Act of 11 September 2019 on Public Procurement, hereinafter referred to as the "Public Procurement Act" or "P.P.A.", and the present Specification of Contract Conditions, hereinafter referred to as the "S.C.C." 2. The estimated value of the contract exceeds the amount specified in the announcement of the President of the Public Procurement Office issued under Article 3(2) of the P.P.A. 3. The Contracting Authority intends to apply the so-called reverse procedure, as referred to in Article 139(1) of the P.P.A., i.e. the Contracting Authority will first carry out an examination and evaluation of the tenders, and then will qualify the Contractor, whose tender has been highest evaluated, in terms of lack of grounds for exclusion and meeting the conditions for participation in the procedure. 4. The Contracting Authority allows the submission of partial tenders. The subject of the contract has been divided into six (parts/tasks): Package 1 (part) Delivery of Welders and UV Lamps; Package 2 (part) Delivery of Incubators; Package 3 (part) Delivery of steam, vertical autoclaves with accessories; Package 4 (part) Delivery of a Class II microbiological safety laminar flow cabinet; Package 5 (part) Delivery of electric, compressor refrigerated truck freezers. 5. A detailed description of the subject of the contract and specific requirements regarding individual products for deliveries are specified in the annexes: Annex No. 1a Description of the Subject of the Contract for Package No. 1, Annex No. 1b Description of the Subject of the Contract for Package No. 2, Annex No. 1c Description of the Subject of the Contract for Package No. 3, Annex No. 1d Description of the Subject of the Contract for Package No. 4, Annex No. 1e Description of the Subject of the Contract for Package No. 5. 6. The subject of the contract includes the delivery of a new and fully functional assortment in accordance with the requirements specified in the documents of the procedure to the places indicated in the Draft Contract Terms for Public Procurement. 7. The Contractor may entrust the execution of part of the contract to a subcontractor(s). 8. The Contracting Authority does not reserve the obligation of personal performance by the Contractor of key parts of the contract. 9. The Contracting Authority requires the Contractor to indicate in the JEDZ (Part II, Section D) the part of the Subject of the Contract, the execution of which the Contractor intends to entrust to Subcontractors, and to provide any Subcontractors, if they are already known. 10. In the event of entrusting the execution of part of the subject of the contract to Subcontractors, the Contracting Authority does not require the submission of JEDZ relating to those Subcontractors, with the exception of the case where the subcontractor is also a party to the resources of which the Contractor refers. 11. Failure to indicate the scope of subcontracting will be considered as a declaration at the stage of tender submission of independent execution of the Contract by the Contractor who submitted the Tender. 12. The Contracting Authority does not provide for the possibility and does not require the submission of a tender after the site visit or verification of documents relating to the contract which are at the disposal of the Contracting Authority, and which will be made available to entities expressing the intention to participate in the procedure 13. The contract is co-financed from the funds of the Civil Protection and Civil Defence Programme for 2025-2026. 14. The Contracting Authority reserves the right to invalidate the procedure for awarding the contract if the public funds, which the Contracting Authority intended to allocate for the financing of the whole or part of the contract, are not granted to it. 15. The Contractor, in order to confirm the fulfilment of the conditions for participation in the procedure and the demonstration of the lack of grounds for exclusion, is obliged, in accordance with the instruction referred to in Chapter XV of this S.C.C., to submit the JEDZ, whereby the JEDZ must be submitted under pain of invalidity in electronic form, and the file must be equipped with a qualified electronic signature. 16. In the case of joint tendering for the contract by Contractors, the JEDZ in electronic form, equipped with a qualified electronic signature, is submitted under pain of invalidity by each of the Contractors jointly tendering for the contract. These declarations confirm the lack of grounds for exclusion and the fulfilment of the conditions for participation in the procedure in the scope in which each of the Contractors demonstrates the fulfilment of the conditions for participation in the Procedure. 17. The Contracting Authority does not require the submission of a bond. 18. The Contracting Authority does not require the submission of a guarantee of proper performance of the contract. 19. All information not included in the content of the contract notice, but essential for the procedure, is contained in the S.C.C. - please ask Contractors to familiarise themselves thoroughly with its content. 20. Detailed information on personal data protection has been included in the annex to the S.C.C. - RODO Clause.
