Poland – Fuels – „Sukcesywna dostawa paliw płynnych w systemie sprzedaży bezgotówkowej na podstawie kart flotowych dla Zakładu Wodociągów Kanalizacji i Usług Komunalnych Sp. z o.o. w Świebodzinie w 2027 r.”

The subject of the contract is the successful purchase by the Buyer of liquid fuels (implemented in the fleet card system), directly at the fuel station for vehicles and construction equipment owned by Zakład Wodociągów Kanalizacji i Usług Komunalnych Sp. z o.o. in Świebodzin, from the date of signing the contract (but not earlier than 01.01.2027) until 31.12.2027, in the following estimated quantities:

4.2 The fuel subject to the order must meet the requirements and standards specified in the regulation of the Minister of Climate and Environment of 26 June 2024 on quality requirements for liquid fuels (Journal of Laws of 2024, item 1018). The Contractor ensures the possibility of controlling the quality of fuels, taking samples and presenting quality documents in accordance with the rules specified in § 6 of the contract project, which is Annex No. 3 to SWZ. The costs of performing the Contractor's obligations in this respect should be included in the offer price. The rules for bearing the costs of taking samples and tests are specified in § 6 of the contract project.

4.3 Settlements for the delivered fuel will be made based on the actual quantities of fuel purchased and the unit price applicable on the date of purchase (refuelling), determined based on the wholesale price of fuel net, converted to 1 litre, published on www.orlen.pl in the "wholesale fuel price" tab for diesel oil Ekodiesel and unleaded petrol Eurosuper 95, and increased by the value corresponding to the percentage margin provided by the Contractor in the offer form. In case of documented lack of information about the wholesale price on www.orlen.pl on the date of purchase, the wholesale price from the nearest previous day for which the price was published will be applied. A negative margin is allowed. Reference to ORLEN listings serves to determine the price and does not imply an obligation to supply fuel of a specified brand or from that manufacturer.

4.4 The Buyer guarantees the acceptance of fuels at a level not lower than 50% of the quantity of each type of fuel described in point 4.1.

4.5 The Buyer, under the conditions specified in the contract template, will provide the Contractor with a list of vehicles and their registration numbers authorised to refuel at the Contractor's station. The quantities of fuels included in the order in point 4.1 do not constitute the Buyer's obligation to purchase them in this maximum quantity, subject to further provisions of SWZ. The delivery will be settled based on the actual fuel purchases made at the Contractor's station, while the Buyer envisages a reduction in the scope of the order in relation to the delivery of fuel quantities in accordance with the rules specified in Annex No. 3 to SWZ. The Buyer informs that the reduction in the scope of the order will not exceed 50% of the quantity of each type of fuel mentioned in point 4.1 above.

4.6 The person refuelling the vehicle will be obliged to have a personalised fleet card provided by the Contractor.

4.7 The Contractor will equip the Buyer with at least 46 fleet cards, with the validity period covering the order execution period.

4.8 The Contractor will record the quantities of fuels issued within the subject of the order in a separate list, and the person taking the fuel will confirm the refuelling operation and the quantity and type of fuel taken with their own signature.

4.9 Requirements regarding the fuel station provided by the Contractor for the entire order execution period:

a) the fuel station must be equipped with a minimum of 6 (six) distributors for diesel oil ON and at least 1 (one) distributor for unleaded petrol PB;

b) the fuel station must be located no further than 8 km (from the seat of Zakład Wodociągów Kanalizacji i Usług Komunalnych Sp. z o.o., located at ul. Młyńska 37, 66-200 Świebodzin, by public roads);

c) the fuel station must be open 7 days a week, 24 hours a day;

d) the transaction must be confirmed by signing the issue document by card users and the station's service.

The Buyer, in order to demonstrate compliance with the condition referred to in point 4.9 lit. a, allows the Contractor to refer to the same fuel distributor, the equipment of which will enable refuelling both diesel oil ON and unleaded petrol PB.
