Italy – Ironmongery – FORNITURA DI FERRAMENTA COMPRENSIVO DI TRASPORTO (CONSEGNA) PER PRODUZIONI TELEVISIVE DEL CPTV DI ROMA, MILANO, TORINO E NAPOLI

Framework Agreement with a single operator pursuant to Article 59, paragraph 3 of the Code for the supply of tools, including transport (delivery) for television productions of CPTV in Rome, Milan, Turin and Naples. The list of material subject to supply is detailed in the tender documentation. The supply includes technical and safety data sheets of the materials supplied and declarations of conformity issued by the manufacturer in accordance with the law, as well as any charges related to transport and delivery to one of the Rai warehouses in Rome, Milan, Naples or Turin. Rai will enter into a Framework Agreement with the successful tenderer for a period of 36 months from the date of signature of the framework agreement, under which the contractor will be obliged to perform the services subject to the contract, in accordance with the technical specifications of the Specification at the unit prices offered. The tender documents will include the following provisions pursuant to Article 120, paragraph 1, letter a) of the Code: - if the contractual amount is not exhausted at the end of the contractual period, the duration of the framework agreement may be extended for the time necessary to use the entire contractual amount (subject to the non-binding nature of the services); - in the event of necessity during the contractual period, Rai reserves the right to modify pursuant to Article 120, paragraph 1, letter a) of the Code to modify/compensate the dimensional capacity of each contractual item. In particular, Rai, depending on specific needs, due to the greater use of one contractual item over another, may reduce the less used item in favour of increasing the more used item, subject to the overall value of the framework agreement; - the right to request the contractor, during the duration of the framework agreement, if it becomes necessary to increase or decrease the services up to one fifth of the contract amount of 63,480 euros, also pursuant to Article 120, paragraph 9, of the Code, to impose on the contractor the performance under the originally agreed conditions. In this case, the contractor may not invoke the right to terminate the framework agreement. In exceptional cases, if the conditions indicated in Article 120, paragraph 11 of the Code occur, the duration of the Framework Agreement, even if extended as described above but still in execution, may be further extended for the strictly necessary time to complete the procedure for identifying the new contractor (subject to the non-binding nature of the remaining amount as expressed above). In this case, the contractor will be obliged to perform the services subject to the framework agreement at the same prices, terms and conditions as set out in the contract.
