Poland – Electricity, heating, solar and nuclear energy – Zakup energii cieplnej obejmujący dystrybucję i zakup energii cieplnej dla szkół i placówek oświatowych w dzielnicy Bemowo m. st. Warszawy na okres 2 lat z możliwością wznowienia o kolejne 2 lata (01.01.2027 – 31.12.2028 + 01.01.2029-31.12.2030

1. The subject of the contract is the purchase of thermal energy including the distribution and purchase of thermal energy for 25 schools and educational facilities in the Bemowo district of Warsaw. The detailed scope of the contract is specified in Annex No. 4 to the SWZ. 2. The estimated levels of thermal energy consumption are based on the actual historical consumption of thermal energy from 2025-2026. 3. The contracting authority declares that the forecasted consumption of thermal energy is estimated for a period of 2 years with the possibility of renewal for a further 2 years. 4. The forecast serves solely for the comparison of tenders and in no way constitutes a commitment by the contracting authority to purchase thermal energy in the specified quantity. The contractor will not have any claim for the non-purchase by the contracting authority of the forecasted quantity of thermal energy. 5. The contractor will be responsible for the entire scope, including the progress and timely execution of the contract, for the quality, and compliance with the technical and quality conditions specified for the subject of the contract. Due diligence is required in the execution of the contract, understood as the diligence of a professional in the activity covered by the subject of this contract. 6. The contracting authority envisages the possibility of a one-time renewal of the contract (Article 31(2) of the Pzp Act) for a further 24 months, i.e. for the years 2029-2030 (from 01.01.2028 to 31.12.2030). By renewal, the contracting authority means the execution of the subject of the contract to the greatest extent possible, in the quantity resulting from the current needs of the facilities, at prices in accordance with the applicable tariff. 7. The estimated total remuneration due to the contractor for the implementation of the renewal by the contractor amounts to 17 115 852,44 zł gross.
