Poland – Generator units – Zakup, dostawa i montaż agregatów prądotwórczych

The subject of the contract is the supply and installation of 9 power generators with a capacity from 40 kVA to 50 kVA for the facilities of the entities and the organ for the protection of the population and civil defence in order to ensure the continuity of power supply in crisis, emergency or natural disaster situations. The contract also includes the performance of works related to installation and assembly, including preparatory works, placing the plate for the generator, placing the power generator, laying internal supply and control lines, installing the Reserve Connection System (SZR), tidying up and performing control measurements. The detailed scope of the works has been defined in Attachment No. 1 to SWZ – Description of the subject of the contract (with a breakdown by subsequent locations, items, technical projects, STWiOR). 2. The supply and installation, mentioned in point 1, covers the following locations: - Zespół Szkół Ponadpodstawowych nr 2 in Jarocin ul. Franciszkańska 2 and ZSP nr 1 in Jarocin - ul. Franciszkańska 1 (3 units), - Liceum Ogólnokształcące im. T. Kościuszki nr 1 in Jarocin ul. Kościuszki 31 (1 unit), - Zespół Szkół Przyrodniczo - Biznesowych im. Jadwigi Dziubińskiej in Tarcze – Tarce 19 (1 unit), - Zespół Szkół Specjalnych in Jarocin – ul. Szubianki 21 (1 unit), - Powiatowy Urząd Pracy in Jarocin - ul. Zaciszna 2 (1 unit), - Starostwo Powiatowe in Jarocin building at ul. Kościuszki 10 (1 unit), - Starostwo Powiatowe in Jarocin building at ul. Zacisznej 2a (1 unit) 3. The detailed scope of the subject of the contract has been defined in Attachment No. 1 to SWZ. 4. The subject of the contract described in Attachment No. 1 to SWZ must be: – factory new, – free from defects, – not showing signs of use, – fully technically functional, – delivered by the Contractor at their own expense, including packaging, transport, unloading and insurance, – delivered and installed by the Contractor together with the necessary documentation indicated in the Contract, which is Attachment No. 2 to SWZ. 5. The subject of the contract will be carried out as part of the investment task entitled: "Purchase, supply and installation of power generators". 6. The subject of the contract is co-financed from the budget of the State within the framework of the "Programme for the Protection of the Population and Civil Defence for 2025-2026 – Area 2: Logistical security and ensuring the continuity of supplies" and from the funds of Powiat Jarociński. 7. The requirements specified in Attachment No. 1 to SWZ are minimum requirements. The contract allows for the offering of equipment with better parameters. 8. To the words used in Attachment No. 1 to SWZ defining trademarks, patents, origin, source or a particular process that characterizes the products or services supplied by a specific Contractor, in each case the words: "or equivalent" are added. 9. Any indication in Attachment No. 1 to SWZ of trademarks, patents or origin, source or a particular process that characterizes the products or services supplied by a specific Contractor is merely exemplary (illustrative) and equivalent solutions, equivalent products that meet all the minimum technical, quality, functional and user requirements listed in the contract document are permitted. 10. Whenever in Attachment No. 1 to SWZ the subject of the contract is described by reference to standards, technical assessments, technical specifications and technical reference systems, the contract adds the words "or equivalent" in each case and permits equivalent solutions to those described. 11. The Contractor who refers to equivalent solutions described by the Contracting Authority in Attachment No. 1 to SWZ is obliged to prove in the offer, in particular by means of the subject evidence means referred to in Articles 104 – 107 of the PZP Act, e.g. appropriate technical and/or functional descriptions, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent and that the supply or service meets the requirements regarding performance or functionality specified by the Contracting Authority. 12. If the Contractor does not submit the subject evidence means with the offer or the submitted evidence means are incomplete, the Contracting Authority, in accordance with Article 107(2) of the PZP Act, will call for their submission or completion within the specified deadline. 13. The Contracting Authority has not divided the subject of the contract into parts. The contract has not been divided into parts because, for technical, organisational and economic reasons, it forms an indivisible whole. The award of a single contract is justified by objective reasons. In the event of the contract being divided into parts, there would be a need to coordinate the actions of different contractors implementing the individual parts of the contract. This could seriously threaten the timely and proper execution of the contract, and the failure to complete the task within the deadline specified in the agreement on the grant of a targeted subsidy for the co-financing of the task within the scope of the protection of the population and civil defence covered in the key areas of action within the Programme for the Protection of the Population and Civil Defence for 2025-2026 – Area 2: Logistical security and ensuring the continuity of supplies, would result in the loss of co-financing obtained by Powiat Jarociński. 14. The contract does not allow for the submission of partial offers. 15. The contract does not provide for the reimbursement of participation costs. 16. The contract does not provide for settlement in foreign currencies. 17. The contract does not provide for the granting of advances on account of the execution of the contract. 18. The contract does not allow contractors, contractors jointly applying for the award of the contract and subcontractors from third countries not being parties to international agreements to participate in the procedure for the award of a public contract. 19. The contract allows, in the procedure for the award of a public contract, supplies (products) originating from third countries not being parties to international agreements. 20. Products and equipment being the subject of the contract must have CE marking (unless specific regulations provide otherwise). 21. The description of the subject of the contract does not take into account the requirements in the field of accessibility for disabled persons due to the nature of the subject of the contract. 22. The contract does not provide for contracts, as referred to in Article 214(1)(8) of the PZP Act. 23. All documents submitted with the offer in a foreign language should be submitted with a translation into Polish.
