Poland – Construction work – Rozbiórka i budowa nowego dworca kolejowego Koszalin

1. The subject of the contract is a construction project involving the completion of construction works for the investment task: "Demolition and construction of the new Koszalin railway station". 2. The description of the subject of the contract, hereinafter referred to as "OPZ", is Annex No. 1 to SWZ (contains: construction project, technical project, execution project, technical specifications for the execution and acceptance of works and work items, building permit). The Purchaser emphasizes that all works within the scope of the contract must be carried out in accordance with the project documentation, technical specifications for the execution and acceptance of construction works, guidelines from the Purchaser, recommendations and decisions issued, and legal provisions and standards. The Purchaser indicates that the work items have an ancillary nature and do not constitute a closed catalogue of work descriptions. 3. The Contractor is obliged to implement the contract on the terms and conditions specified in the Contract Template – Annex No. 11 to SWZ, hereinafter referred to as the "Contract" and in the OPZ – Annex No. 1 to SWZ. 4. The Purchaser requires an obligatory site visit, as referred to in Article 131(2)(1) of the Pzp Act, of the area covered by the subject of the contract. The purpose of the visit is to check (visual inspection) the site conditions necessary for preparing the offer. The site visit will take place on the following dates: 1) 28.04.2026, 12:00, 2) 30.04.2026, 12:00, 3) 05.05.2026, 12:00, 4) 21.07.2026, 12:00. Contractors are obliged to notify the Purchaser, in accordance with the provisions of Chapter XII, no later than the day before the chosen date of the visit, by 10:00, of the names of the Contractor's representatives who will participate in the site visit and the date of the visit. The application should be submitted via the Platform in the "Questions/Information" tab through the "Add question/comment" command. The Purchaser will immediately provide the notified Contractors with detailed information regarding the organizational matters related to the conduct of the site visit within the deadline set by the Purchaser. The site visit will be conducted with the participation of a representative of the Purchaser. A protocol (the protocol template is Annex No. 13 to SWZ) will be drawn up from the conducted site visit, signed by the representatives of the Contractor and the Purchaser. Failure to participate in the site visit will result in the rejection of the Contractor's offer on the basis of Article 226(1)(18) of the Pzp Act. 5. The Contractor or subcontractor is obliged to employ, under an employment contract, persons performing work, within the meaning of Article 22(1) of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277, as amended). The obligation to employ applies to employees who, under the Contract that will be concluded as a result of the award of the subject contract, will perform activities in the scope of works: a) masonry, painting, plastering, activities performed as a mason's assistant, b) fitting in the scope of sanitary installations, c) fitting in the scope of electrical installations, d) settlement and maintenance of construction documentation. 6. The rules for documenting employment, controlling the Contractor's or subcontractor's compliance with the requirements regarding employment under an employment contract, and the provisions regarding sanctions for non-compliance, have been specified in § 3(10) of the Contract Template constituting Annex No. 11 to SWZ. 7. The Purchaser requires that, during the implementation of the contract, persons sent by the Contractor to implement the contract, listed in Chapter IX(2)(4)(b) of SWZ, communicate with the Purchaser in Polish or through a Polish translator. In correspondence between the Contractor and the Purchaser, Polish is considered the official language, however, the Purchaser in this case requires the Contractor's staff to use the Polish language at the C1 level - according to the scale adopted by the Council of Europe – CEFR Common European Framework or through a Polish translator, and in correspondence between the Contractor and the Purchaser, Polish is considered the official language at least at the above-mentioned level of proficiency. 8. The Purchaser envisages the granting of advances for the implementation of the contract. The rules and conditions for granting an advance, including the security of the advance, have been specified in the Contract Template constituting Annex No. 11 to SWZ. 9. The Contractor is obliged to perform all activities arising from the SWZ and undertakes to comply with the requirements in accordance with the "Procedure regarding the requirements in the field of OHS for Contractors and Subcontractors providing services for PKP S.A." - which is Annex No. 7 to the Contract (in the scope of OHS regulations). 10. The Purchaser envisages the award of contracts, as referred to in Article 388(2)(c) of the Pzp Act, to the current Contractor, involving the repetition of similar construction works as in the main contract and consistent with its subject. 11. The total value of the above contracts will not exceed 20% of the value of the main contract. 12. The scope and conditions for awarding similar contracts have been specified in Chapter VII of SWZ. 13. The Purchaser allows the possibility of entrusting the execution of part of the contract to subcontractors. 14. The Contractor is obliged to indicate in the JEDZ declaration, the template of which is Annex No. 3 to SWZ, and the Tender Form, the template of which is Annex No. 2 to SWZ, the part of the contract, the execution of which it intends to entrust to subcontractors, and to provide the names of the subcontractors (if known at the current stage). 15. The value in the Contract Scope section is the value of the main contract, including contracts, as referred to in Article 388(2)(c) of the PZP Act.
