2. PROCEDURE FOR AWARDING THE CONTRACT

2.1. The procedure is conducted as an unrestricted tender in accordance with the provisions of the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended; hereinafter: PZP) and the executive acts to the PZP.

2.2. The procedure is conducted in accordance with the rules provided for classical procurements with a value equal to or higher than the amounts specified in the notice of the President of the Public Procurement Office issued under Article 3(2) of the PZP.

2.3. The procedure will be conducted in accordance with the rules provided for the so-called "reverse tender evaluation order", as referred to in Article 139 of the PZP. Pursuant to the aforementioned provisions, the Contracting Authority will first carry out an examination and evaluation of the tenders, and then carry out the qualification of the Contractor, whose tender was highest evaluated, in terms of the grounds for exclusion and the fulfilment of the conditions for participation in the procedure.

3. DEFINITIONS

Whenever in this SWZ there is mention of:

a) PZP - this shall be understood to mean the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended),

b) Directive 2014/24/EU – this shall be understood to mean Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (OJ EU. L. of 2014, No. 94, p. 65, as amended),

c) contract - this shall be understood to mean the public contract to which this SWZ relates,

d) procedure - this shall be understood to mean the procedure for awarding the contract,

e) Contracting Authority – this shall be understood to mean the Contracting Authorities listed in Section 1, Part I of the SWZ,

f) working day - this shall be understood to mean a day that is not a day recognised by law as a non-working day or a Saturday,

g) price – this shall be understood to mean the price in the sense of Article 3(1)(1) and (2) of the Act of 9 May 2014 on the provision of information on the prices of goods and services (i.e. Journal of Laws of 2023, item 168), even if it is paid to a person who is not an entrepreneur,

h) Contractor – this shall be understood to mean a natural person, a legal person or an organisational unit not having legal personality, who offers on the market the execution of construction works or a construction object, the supply of products or the provision of services or applies for the award of a contract, has submitted a tender or has concluded a contract for a public contract,

i) consortium – this shall be understood to mean Contractors jointly applying for the award of a contract,

j) SWZ, specification – this shall be understood to mean this specification of contract conditions,

k) single document/JEDZ (European Single Procurement Document) – this shall be understood to mean a declaration made on the form of the European Single Procurement Document, drawn up in accordance with the standard form specified in the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the European Single Procurement Document,

l) qualified electronic signature - a signature issued by a qualified trust service provider being a subject providing certification services and based on a qualified electronic signature certificate. The electronic signature must meet the security requirements specified in the Act of 5 September 2016 on trust services and electronic identification (i.e. Journal of Laws of 2024, item 1725) and Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (OJ EU. L. of 2014, No. 257, p. 73, as amended; eIDAS Regulation),

m) tender – this shall be understood to mean the Tender Form submitted in electronic form together with the remaining documents required in the procedure documentation, meeting the provisions of Article 78(1)(1) of the Civil Code of 23 April 1964 (i.e. Journal of Laws of 2026, item 795) (c.c.) and Article 66(1) of the c.c. in conjunction with Article 8(1) and Article 63(1) and Article 218(2) of the PZP,

n) partial tender - this shall be understood to mean a tender providing, in accordance with the contract documents, for the execution of part of the contract;

o) subjective evidentiary means - this shall be understood to mean means serving to confirm the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure, with the exception of JEDZ, PROJECTED CONTRACT TERMS - Section 22 of the SWZ EMPLOYMENT REQUIREMENTS - Section 24 of the SWZ OTHER INFORMATION - Section 25 of the SWZ INFORMATION OBLIGATION - Section 26 of the SWZ

4. DESCRIPTION OF THE CONTRACT

4.1. The subject of the contract is: comprehensive provision of a service related to the acceptance and management of municipal waste, entitled "Management of municipal waste from uninhabited properties in the area of the Municipality of Środa Wielkopolska in 2027".
