Poland – Pharmaceutical products – 244/PN/2026 - Dostawa produktów leczniczych w ramach importu docelowego dla UCK

The subject of the contract is the supply of medicinal products for the purpose of direct import for UCK, in the assortment, estimated quantity and requirements as specified in Annex 3 to the SWZ. 2. The contracting authority allows the submission of partial offers. The term partial offer refers to individual items as listed in Annex 3 to the SWZ. The contractor may submit an offer for one or more items. 3. The contracting authority does not agree to changes in Annex 3 to the SWZ – the assortment and price form, under pain of rejection, with the exception of the following situation: The contracting authority agrees to: - a change in the form of the proposed preparations, for example from vials to ampoules or ampoule-syringes and vice versa; - a change in the form of the proposed preparations, for example from tablets to coated tablets or capsules or lozenges and vice versa; - a change in the size of the packaging after the appropriate conversion of units. 4. Deliveries will be made successively, in quantity and assortment, in accordance with the partial orders of the contracting authority within 21 days from the date of the order. The ordered assortment the contractor is obliged to deliver at his own cost to the Hospital Pharmacy. 5. The contracting authority requires that the prices of the drugs offered are not higher than the official prices, as defined in art. 9 para. 1 and 2 of the Act of 12.05.2011 on the reimbursement of drugs, special dietary foods and medical devices (Dz.U. 2025 poz. 907), in force on the date of submission of offers – if applicable. 6. The offered medicinal products must be in accordance with the Act of 6 September 2001 on Pharmaceutical Law (Dz.U. 2025 poz. 750) – if applicable. The offered medicinal products must be approved for sale in Poland in accordance with the provisions of art. 3 or 4a of the Pharmaceutical Law. 7. The offered medical devices must be in accordance with the Act of 7 April 2022 on medical devices (Dz. U. z 2024 r. poz. 1620) and the implementing acts issued on the basis of this Act – if applicable. 8. The contracting authority allows the submission of an equivalent offer in the scope of items 20, 52. The contracting authority informs that all trade names used in the description of the subject of the contract, specify the required standard of the ordered assortment. The contracting authority allows the submission of offers with equivalent quality parameters, having an identical chemical composition in terms of basic substances. The proof of meeting the condition of equivalence lies with the contractor. 9. In the event that the contracting authority used in the description of the subject of the contract designations of standards, technical assessments, technical specifications and technical reference systems, as referred to in art. 101 para. 1 point 2 and para. 3 of the Pzp, equivalent solutions are allowed. Whenever a standard is indicated in this SWZ or in the annexes to the SWZ, it should be assumed that the formulation "or equivalent" has been used in relation to it. In the event that the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems, as referred to in para. 1 point 2 and para. 3, the contracting authority may not reject an offer solely on the grounds that the offered supplies are not in accordance with the standards, technical assessments, technical specifications and technical reference systems, to which the description of the subject of the contract refers, provided that the contractor proves in the offer, in particular by means of the subject-matter evidence, as referred to in art. 104-107, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 10. The contracting authority requires the submission of offers in electronic form. A detailed description (instruction) for the submission of offers in electronic form is contained in Section XIV of the SWZ. The contracting authority informs that in the present procedure for the award of a public contract, the so-called "reverse order of evaluation of offers", as referred to in art. 139 of the PZP, will be applied. By applying the above procedure, the contracting authority will first examine and evaluate the offers, and then qualify the contractor whose offer was highest rated in terms of lack of grounds for exclusion and meeting the conditions for participation in the procedure. 14. The contractor may entrust the execution of part of the contract to a subcontractor. 15. The contracting authority does not allow the submission of variant offers. 16.
