Description

The subject of the public procurement is the conclusion of a framework agreement in accordance with § 131 and subsequent provisions of the law. The framework agreement will be concluded for a period of 4 years, or until the financial limit of 250,000,000 CZK excluding VAT is exhausted, whichever occurs first (hereinafter also referred to as the "framework agreement"). The framework agreement will be concluded between the aforementioned contracting authority and up to 10 participants in the tendering process, specifically with those participants who, after evaluation, are placed in the first to tenth position. If the contracting authority is unable to conclude a framework agreement with the number of suppliers stated in the preceding sentence (i.e., 10 suppliers) due to an insufficient number of tenders being submitted or these tenders not meeting the requirements set by the law or the contracting authority, or an insufficient number of suppliers do not demonstrate compliance with the required qualification, the contracting authority is entitled, in accordance with § 133(2) of the law, to conclude a framework agreement only with those suppliers who meet these requirements. Individual public procurement contracts (mini-tenders) will be awarded based on the framework agreement by a procedure with the renewal of the competition among the participants of the framework agreement in accordance with § 132(3)(a) of the law, and in accordance with § 135 of the law, on the basis of a written invitation from the contracting authority to submit a tender to all participants in the framework agreement made through the electronic tool E-ZAK available at: https://ezak.cnb.cz/. The subject of the performance of the framework agreement, or public procurement contracts awarded on the basis of the framework agreement, is the provision of strategic and transactional advisory services, involving specialized consulting and assistance in resolving crises in the financial market, particularly in assessing and potentially implementing measures for the transfer of activities to a private acquirer in accordance with § 96 and subsequent provisions of Act No. 374/2015 Coll., on recovery proceedings and resolution of crises in the financial market, as amended (hereinafter referred to as "ZOPRK"), transfer of activities to a bridge institution in accordance with § 102 and subsequent provisions of ZOPRK, transfer of activities to a person for the management of assets in accordance with § 113 and subsequent provisions of ZOPRK, or assistance in evaluating a plan for the reorganization of business activities in accordance with § 150 and subsequent provisions of ZOPRK, in relation to the obligated entity or group. The conclusion of a framework agreement in accordance with § 131 and subsequent provisions of the law will enable the contracting authority to award public procurement contracts for the agreed performance according to its current needs. Further specifications of the subject of the performance of the public procurement contract, or public procurement contracts awarded on the basis of the framework agreement, are contained in the draft framework agreement.
