Description

The subject of the contract is the collection, transport and disposal of municipal waste from the owners of inhabited and uninhabited properties (holiday plots, on which holiday homes or other properties used for recreational purposes are located) from the area of the Municipality of Bytoń. The detailed description of the subject of the contract is contained in Annex No. 4 to the Specification of Contract Conditions. 2. The detailed obligations of the contractor in the implementation of the subject of the contract are specified in the draft provisions of the contract regarding the public contract - Annex No. 1 to the Specification of Contract Conditions. 3. The contracting authority does not allow the submission of partial tenders – justification for the lack of division of the contract into parts: The division of the subject of the contract into parts is unreasonable from a technical and organisational point of view. The division of the scope into parts, which would constitute the whole of the contract, would result in excessive technical difficulties and excessive costs of contract execution. The need to coordinate the actions of different contractors implementing individual parts of the contract could seriously threaten the proper execution of the contract. 4. When executing the contract, the Contractor undertakes to apply the requirements specified in Article 68a in conjunction with Article 68b point 3 lit. d of the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2024, item 1289, as amended). 5. Requirements regarding employment under an employment contract, in the circumstances referred to in Article 95 of the Public Procurement Law: The contracting authority requires the contractor or subcontractor to employ, under an employment contract, persons performing activities within the scope of contract implementation, if the performance of these activities involves performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (i.e. Journal of Laws of 2025, item 277) concerning physical workers, drivers, waste collectors, site cleaners, bin placers, who will participate in the implementation of the subject of the contract. In order to verify the employment, by the contractor or subcontractor, under an employment contract, of persons performing the activities indicated by the contracting authority within the scope of contract implementation, the contracting authority requires, in particular, the submission of a declaration by the contractor or subcontractor of the employment of a worker under an employment contract, containing information, including personal data, necessary to verify employment under an employment contract, in particular the first and last name of the employed worker, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker's obligations - no later than on the date of conclusion of the Contract. In the event of the need to introduce changes in the composition of the team performing the work, the Contractor shall notify the contracting authority of this fact. During the implementation of the contract, the contracting authority is entitled to perform control activities towards the contractor or subcontractor, regarding the fulfilment by the contractor or subcontractor of the requirement to employ, under an employment contract, persons performing the activities indicated above. In order to verify, within the framework of control activities, the employment, by the contractor or subcontractor, under an employment contract, of persons performing the activities indicated by the contracting authority within the scope of contract implementation, the contracting authority provides for the possibility of requiring, in particular: a) a declaration by the employed worker, b) a declaration by the contractor or subcontractor of the employment of a worker under an employment contract, c) a certified copy of the employment contract of the employed worker, conforming to the original, d) other documents - containing information, including personal data, necessary to verify employment under an employment contract, in particular the first and last name of the employed worker, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker's obligations. In the event of justified doubts as to the observance of labour law by the contractor or subcontractor, the contracting authority may request the State Labour Inspectorate to carry out a control. 6. Variant offers: The contracting authority does not allow the submission of variant offers. 7. Supplementary contracts: The contracting authority does not envisage the award of contracts, as referred to in Article 214(1)(7) of the Public Procurement Law. 8.
