The prices for the maintenance service must – in addition to the prices for the main services - be entered by the bidders in the bill of quantities and will be included in the bid evaluation. The maintenance services can be optionally called upon as needed by the contracting authority, at the latest at the time of acceptance of the completed facility. The term of the maintenance contract is 5 years from acceptance. There is no obligation on the part of the contracting authority to utilise the option. This means that the future contractor has no legal claim to the call-up of the maintenance services, but is obliged to provide the maintenance service if the option is exercised by the contracting authority. With the award of the contract, the option right becomes part of the contract. The exercise of the option right by the contracting authority does not constitute a new contract in legal terms.
