Poland – Ice-clearing services – Zimowe utrzymanie dróg wojewódzkich na terenie działania Rejonu Dróg Wojewódzkich w Białogardzie

The subject of the contract is the provision of winter maintenance services for provincial roads managed by the Zachodniopomorski Zarząd Dróg Wojewódzkich in Koszalin within the area of operation of the Białogard Provincial Roads District, divided into 10 tasks: Task No. 1 – Kołobrzeg; Task No. 2 – Białogard; Task No. 3 – Świdwin; Task No. 4 – Połczyn-Zdrój; Task No. 5 – DW 112; Task No. 6 – Winter maintenance of pavements in Połczyn-Zdrój; Task No. 7 – Winter maintenance of pavements in Białogard; Task No. 8 – Winter maintenance of pavements in Kołobrzeg; Task No. 9 – Winter maintenance of pavements in Karlino and Rymań; Task No. 10 – Winter maintenance of pavements in Świdwin. The detailed location and scope of services for a given task are specified in Section C SWZ - Description of the subject of the contract and in the Price Forms (templates 4.1 – 4.10) SWZ. 2. The contractor is obliged to implement the subject of the contract using ICT products, ICT services and ICT processes for which no recommendations have been issued, as referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the security of the state, or a decision or other act in connection with which a given ICT product, ICT service or specific ICT process should be withdrawn from use. 3. The contracting authority envisages the possibility of awarding similar contracts, i.e. contracts at the discretion of the contracting authority, as referred to in Article 305(1) in conjunction with Article 214(1)(7) of the Act – Public Procurement Law. 1) The scope of the services involves the repetition of similar services, in line with the subject of the main contract; 2) The value of the services is set at a net amount of: Task No. 1 - 516,554.00 PLN; Task No. 2 - 1,282,067.00 PLN; Task No. 3 - 1,023,055.00 PLN; Task No. 4 - 368,608.00 PLN; Task No. 5 - 415,072.00 PLN; Task No. 6 - 95,191.00 PLN; Task No. 7 - 235,544.00 PLN; Task No. 8 - 123,605.00 PLN; Task No. 9 - 368,703.00 PLN; Task No. 10 - 1,028,967.00 PLN. 3) The basis for determining the conditions for the implementation of a similar contract is the main contract and negotiations conducted with the contractor. 4. Pursuant to Article 95(1) of the Act – Public Procurement Law, the contracting authority requires the contractor or subcontractor to employ, under an employment contract, persons performing the following activities during the implementation of the contract, if their performance involves performing work in the manner specified in Article 22(1) of the Labour Code: 1) operation of equipment and vehicles used to provide winter road maintenance services, including activities performed by equipment operators and drivers; 2) manual performance of activities related to winter maintenance of pavements, in particular snow removal and removal of winter slipperiness. 5. This obligation also applies to subcontractors. The contractor is obliged to include in every subcontracting agreement the appropriate provisions obliging subcontractors to employ, under an employment contract, all persons performing the activities indicated above.
