Poland – Miscellaneous food products – Sukcesywna dostawa artykułów ogólnospożywczych dla wskazanych jednostek podległych Gminie Stalowa Wola.
Description
The subject of the contract is the successive delivery of general foodstuffs for the indicated units subordinate to the Municipality of Stalowa Wola, specified according to the assortment-price groups for the individual units served, constituting Annex No. 2 (assortment-price form) to the specification of the contract conditions. The subject of the contract will be implemented successively in quantities resulting from the demand submitted directly by the Served Unit. Deliveries will be made based on an order placed by telephone, e-mail or fax, by an employee authorized by the unit. The quantities specified in the assortment-price form are estimated and may decrease/increase during the execution of the contract, and the Contractor is not entitled to any compensation claims in this regard. It is possible to change the quantity of individual assortment mentioned in the Assortment-Price Form – Annex No. 2 to SWZ. All the Purchasers indicated in the SWZ (served unit) have the right to order all the products mentioned in the Assortment-Price Form – Annex No. 2 (even in the case of indicating the quantity position "0") at the unit prices. The Purchaser undertakes to order goods that are the subject of the procedure with a minimum order value of 20% gross as specified in the offer. The financial settlement of the Contractor with the Purchaser will take place on the basis of the quantity and type of food products actually delivered to the Served Unit and their unit prices given by the Contractor in the assortment-price form, i.e. FV payable by bank transfer, with a payment term of 30 days, on a weekly basis. It is possible to invoice each individual delivery of goods or monthly for successive deliveries made within 1 calendar month, at the request of the authorized person/intendant in the given unit. The Contractor will deliver the ordered batch of goods to the indicated units on working days, during the hours specified by the given Purchasing Unit, by their own means of transport and at their own risk, and will not charge the units with transport costs. The Contractor is obliged to deliver the goods to the food warehouses indicated by the Purchasers, located in the facilities of the given units, regardless of whether the storage space is on the ground floor or on the floor, e.g. in a kindergarten canteen. The means of transport must meet the sanitary requirements in force for the transport of foodstuffs. The Contractor will lend containers, boxes, etc. free of charge with each delivery of goods to the Purchaser's seat for the period until the next delivery. All products covered by the order must be delivered in appropriate packaging and boxes (packaging material allowed to come into contact with food). Authorized employees of the individual units (intendant and head of the kitchen) will carry out the acceptance of the goods in terms of quantity-value and applicable quality standards. The units have the right to refuse to accept the goods in case of quantitative or qualitative defects. In the event of a dispute by a given Served Unit regarding the delivered goods, the Contractor undertakes to replace them with a full-value item, within a period not exceeding 2 business days from the lodging of the complaint. The complaint period is an extra-price criterion for evaluating offers (Kt). In the event of non-delivery of full-value goods after a complaint has been lodged, the Served Unit is entitled to purchase the said goods at the Contractor's expense. The disputed goods will be returned to the Contractor and collected by transport at the Contractor's expense. The Served Unit is not liable for losses incurred by the Contractor due to the return of the disputed batch of goods. Goods that show any signs of spoilage (smell, color, consistency, insects in products), have an incorrect use-by date, incorrect expiry date, and mechanical damage to the inner and outer packaging (torn packaging, cracked or crushed boxes) should be replaced from the moment the Purchaser reports it in accordance with the complaint time declared by the Contractor, which is an extra-price criterion for evaluating offers. Food products should be delivered in original, undamaged packaging containing factory markings, i.e. type, product name, quantity, use-by date, manufacturer's name and address, and other markings in accordance with the applicable food law provisions. Delivered food products, depending on their category, must have all the necessary documents required by food law provisions with each delivery. The use-by date or expiry date on the individual packaging of the given assortment, counted from the moment of its delivery, will not be shorter than ½ of the use-by/expire period specified by the manufacturer. The delivered products must be in accordance with the Regulation of the Minister of Health of 16 February 2026 on the groups of foodstuffs intended for sale to children and young people in educational establishments and the requirements that foodstuffs used in the collective catering of children and young people in these establishments must meet (Journal of Laws of 20 February 2026, item 197). The Purchaser additionally reserves the right that no Food Products may contain the following substances or food additives, which should not be found in a child's diet: guar gum, sulphur dioxide, saccharin, aspartame E951, phosphoric acid E338, food colours (E100-E199), artificial flavours, sodium benzoate E211. The ordered products, in their composition, under no circumstances, may contain preservatives, improvers, artificial colourings, etc. (unless the product description contained in Annex No. 2 to SWZ indicates otherwise). The ordered products should be delivered in packaging allowed to come into contact with food.
