Creation of a Dynamic Procurement System (hereinafter: DPS) for the conclusion of business contracts within the service area of Debreceni Hőszolgáltató Zrt. for the construction, renovation, and maintenance of district heating pipelines, as well as for heating plant building services and electrical construction and renovation works, and for industrial maintenance works (painting, insulation, locksmithing) in heating plants. 1) The present procedure is aimed at the creation of DPSs. Given the estimated value of the procedure, the Second Part of the PPA is applied according to Sections 106-107 of the PPA, i.e., the rules of the public procurement procedure aimed at the establishment (so-called first, participation phase) and implementation (so-called second, tendering phase) of the dynamic procurement system (hereinafter DPS). The Inviting Party applies the rules of the participation phase of the invitation procedure for the inclusion in the DPS, and the rules of the tendering phase of the invitation procedure for the procurements within the DPS, with the deviations applicable to the DPS. [Section 107 (1)-(2) of the PPA]. We draw the attention of the Parties to the fact that in the present first, participation phase of the DPS, the Party registering for participation may not submit a tender! 2) The Inviting Party defines 4 categories (parts) in the present participation phase of the DPS. 1. Category (part): Construction, reconstruction of district heating pipelines 2. Category (part): Construction, reconstruction of heating plants 3. Category (part): Joint construction of district heating pipelines and heating plants 4. Category (part): Industrial maintenance of district heating pipeline and heating plant RULES FOR PARTICIPATION REGISTRATION: 3.) As a result of the present participation phase, the Inviting Party intends to establish the DPSs for a period of 36 months per category (part). Parties registering for participation may submit a participation registration for all parts, the Inviting Party does not limit the number of participation registrations that can be submitted. The Inviting Party acts in accordance with Section 106 (1) of the Act CXLIII of 2015 on Public Procurement (hereinafter: „PPA”) and the Government Decree 424/2017. (XII. 19.) on the detailed rules of electronic public procurement (hereinafter: EPPR), using the Electronic Public Procurement System (hereinafter: EPPS). 4) During the existence of the DPS, any economic operator (Party registering for participation) who - is not subject to the exclusion grounds - meets the suitability requirements and - has submitted a participation registration complying with the procurement documents, may request inclusion in the system at any time. The condition for inclusion in the DPS is the submission of the participation registration defined in the procurement documents, the prior proof of compliance with the suitability requirements, and the non-existence of the prescribed exclusion grounds. 5) The possibility of joining the DPS - by submitting a participation registration complying with the procurement documents - is continuous, and in the second, tendering phase, all participants included in the DPS - currently valid number, included in the given procurement part - may submit a tender. A) In the first, participation phase of the DPS, there is an opportunity to submit participation registrations until the participation deadline. B) After the expiry of the participation deadline prescribed in the first, participation phase of the DPS, there is an opportunity to join (submit a participation registration) the already established DPS at any time during its entire period of existence. 6) Therefore, those economic operators who have not submitted their participation registration for inclusion in the DPS by the expiry of the participation deadline in the first, participation phase, may do so at any time during the entire period of existence of the DPS, after the dispatch of the summary of the first, participation phase. In the case of a participation registration submitted after the dispatch of the summary of the first, participation phase, it is also necessary to submit in the participation registration all those documents whose submission is obligatorily prescribed by the participation invitation and the participation documentation. After submitting a valid participation registration, the late registrants are included in the DPS and are only entitled to participate in the second, tendering phase after inclusion. 7) We draw the attention of the registrants to the fact that if they submit their participation registration after the expiry of the participation deadline for the creation of the DPS but before the dispatch of the summary, then their participation registration is considered late in this evaluation phase. In this case, the provisions of point 5) above apply. The Inviting Party sends the tender invitation to those economic operators for the implementation of the specific procurement needs, who have been included in the DPS. If the Party registering for participation submits the participation registration after the establishment of the DPS and the Inviting Party has not yet evaluated the registration before sending the given tender invitation, then the Inviting Party does not send a tender invitation to this Party registering for participation. 8) In the second, tendering phase of the DPS, the Inviting Party evaluates the tenders according to the best price-value ratio selection criterion based on Section 76 (2) c) of the PPA.
