Description
The district of Altenkirchen is currently being partially expanded with broadband networks and bandwidths of up to 1 Gbit/s through a commercial expansion by network operators. In addition, the district receives funding for parts of the supply gaps through the Gigabit Guideline 2.0 and has awarded the construction, operation, and supply with end-customer services according to the economic viability gap model. The commercial and funded expansion are not comprehensive, and supply gaps will remain afterwards. The district of Altenkirchen is responsible for broadband supply for the entire district, with the exception of the former municipal association of Betzdorf, and intends to close parts of these gaps and, with this procedure, to award the construction and operation of an FTTH network within the supply area subject to the procedure, including the provision of end-customer services, on the basis of a service concession in the economic viability gap model according to Section 3.1 of the Gigabit Guideline 2.0. The expansion is to be realised in one lot (see III. - Lot below) with the help of federal, state of Rhineland-Palatinate, and municipal funding, based on the respective grant notifications. The basis for this is, in particular, the guideline "Promotion to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany" - Federal Gigabit Guideline 2.0 (Gigabit Guideline 2.0) - of 31.03.2023 in the version of the second amendment of 13.01.2025, and the framework regulation of the Federal Republic of Germany for supporting the comprehensive expansion of gigabit networks of 01.08.2024. The grant notifications from the federal government and the state are already available to the contracting authority. The bidder is obliged to acknowledge the content of all grant notifications and to observe the requirements resulting from the grant notifications and to pass these on to their subcontractors. The subcontractors are obliged to commit their subcontractors accordingly. The grant notifications are attached to the tender documents. The execution of the services is to be linked to the commercial and funded expansion already initiated in the area, if any, in order to utilise synergies. The planned completion date is in December 2029, which bidders are to use as a basis for their offer calculation. On this basis, the bidder may also specify a different date in the tender documents, which is only binding if an extension can be obtained from the funding provider. By this time at the latest, market-standard broadband services should be available throughout the relevant project area. Own networks, if available, are to be used by the future concessionaire for the planning and construction of the network, as well as existing public infrastructure or network parts to be leased from third parties (if economically viable). The concessionaire assumes the following rights and obligations: (1) Construction of the corresponding broadband infrastructure (2) Installation of the active components (3) Commissioning of the gigabit network (4) Operation of the gigabit network for the duration of the purpose restriction (5) Provision of corresponding services and offers (telephony, internet, added-value services such as e.g. IP-TV, as well as pre-sales products on an open-access basis) to end customers and interested third-party providers at market-standard and/or statutorily prescribed conditions. The services must be completed in each lot no later than six months before the end of the funding period specified in the respective grant notification/amendment notification.
