The procurement of "Furniture for the modernisation of the AN113 hall in the AN Building", in accordance with the specifications in the terms of reference. Number of days until which requests for clarification can be submitted before the deadline for the submission of tenders / applications: 20 days. The contracting authority will respond clearly and completely to all requests for clarification: by the 11th day before the deadline set in the call for participation for the submission of tenders. Any request for clarification must be submitted in SEAP (https://www.e-licitatie.ro). The completion of the award procedure by concluding the public procurement contract is subject to the following suspensive condition, which will operate for a maximum period of 3 months from the deadline for the submission of the tender: The conclusion of the public procurement contract is conditional upon the maintenance of own revenue financing, the signing of the contract being possible only in the situation where the provisions regarding the commitment of expenditures from the budgets that fall under the incidence of the legislation on public finances are respected, and with the respect of the provisions of Decision No. 395/2016 for the approval of the Methodological Norms for the application of the provisions regarding the award of the public procurement contract/framework agreement from Law No. 98/2016 on public procurements, with subsequent amendments and additions. In the event that, for whatever reason, the maintenance of own revenue financing is not achieved, the contracting authority will apply the provisions of art. 212 alin. (1) lit. c) teza a II-a from Law No. 98/2016, with subsequent amendments and additions, making it impossible to conclude the public procurement contract. Bidders within this procedure understand that the Contracting Authority and/or MEC cannot be considered responsible for any damage in the event of the cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or MEC have been notified of the existence of such damage. Bidders within this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any damages they may suffer in the described situation.
