The subject of this order is the provision of a service involving the protection of persons and property. The service is to be carried out in the form of direct physical protection of areas, zones, facilities, and equipment constituting the infrastructure of a military complex administered by 33 WOG in Nowa Dęba. A detailed description of the subject of the order will be presented in the annex to the SWZ, which will be made available to Contractors qualified for the II stage of the procedure (submission of offers). Along with the Specification of Order Conditions, the Ordering Party will also provide a draft contract, a detailed description of the subject of the order, and other annexes necessary for the preparation and submission of an offer. The Ordering Party, taking into account the nature of the subject of the order, does not envisage the inclusion of requirements in the field of accessibility for persons with disabilities in accordance with art. 100, paragraph 1, of the Act of 11 September 2019 – Pzp. The contract for this order will be concluded for a specified period. The service will commence no earlier than 30 September 2026 and will last until 30 September 2027 (basic order). In the event that the Ordering Party exercises the right of option, the service delivery period may be extended to 30 September 2028. The Ordering Party reserves the right that if, due to the inability to conclude the contract by 30 September 2026, for example, due to a prolonged procedure for awarding the order, the service delivery will commence immediately upon the conclusion of the contract, and the Contractors will be entitled to remuneration for the service actually delivered (from the moment the staff enter the complex). The Contractor may entrust the execution of part of the order to a Subcontractor (it is forbidden to entrust the Subcontractor with the execution of the entire subject of the order). Details regarding the entrustment of part of the subject of the order to a Subcontractor will be presented in the SWZ in the II stage of this procedure. The Ordering Party will check whether there are any grounds for exclusion indicated in this Notice for a Subcontractor who is not a party providing the basic resources. Pursuant to art. 411, paragraphs 8-10 of the Act of 11 September 2019 – Pzp, the Ordering Party informs that it does not limit the number of Contractors who will be invited to submit offers (II stage of the procedure). Therefore, the Ordering Party does not indicate in this notice the selection criteria that it intends to apply in order to limit the number of Contractors invited to submit offers. The Ordering Party will invite Contractors whose Applications for Admission to the Procedure are not subject to rejection. In accordance with art. 401, paragraph 1 of the Act of 11 September 2019 – Pzp, “In procedures for awarding orders in the fields of defence and security, communication between the Ordering Party and the Contractors takes place, in accordance with the choice of the Ordering Party, through a postal operator, in the sense of the Act of 23 November 2012 – Postal Law, in person, by courier, by fax or by means of electronic communication”. In this regard, communication in this procedure between the Ordering Party and the Contractor will take place by means of electronic communication, i.e. the Procurement Platform available at: https://platformazakupowa.pl/transakcja/1262449. The Contractor who will be invited to submit an offer will be obliged to secure his offer with a bid bond. Details regarding the submission of the bid bond will be provided in the II stage of the procedure together with the SWZ to Contractors invited to submit a price offer. The offer price, on the basis of which the most advantageous offer will be selected – in accordance with the set criterion for evaluating offers – constitutes the total remuneration of the Contractor that he can obtain for the implementation of the subject of the basic order for the entire service delivery period. Details regarding the method of calculating the price will be described in detail in the SWZ, which will be provided to Contractors invited to submit an offer. The Contractor invited to submit an offer (II stage of the procedure) will be bound by the submitted offer for a period of 90 days. Details regarding the duration of the offer binding period and its termination will be indicated in the Specification of Order Conditions, which will be provided to Contractors invited to submit a price offer at a later stage of the procedure. The Contractor may submit an application to the Ordering Party for clarification of the content of this Notice. The submission of applications for clarification of the content of the Notice by Contractors takes place through the Procurement Platform https://platformazakupowa.pl/transakcja/1262449 in the tab “Send message to the Ordering Party”. Clarifications will be published on the page of the conducted procedure in the tab “Public announcements”. The Ordering Party envisages the possibility of invalidating the subject of the procedure on the basis of art. 310, point 1) of the Pzp Act, i.e. in the event that the funds which the Ordering Party intended to allocate for the financing of the whole or part of the order have not been granted to it. The Ordering Party does not require the submission of subject-related evidentiary documents, referred to in art. 104-107 of the Act of 11 September 2019 – Pzp.
