The Épinal Agglomeration Community has established itself as a purchasing centre to provide buyers subject to the Public Procurement Code, and having their registered office within the territory of the agglomeration, with a system enabling them to meet the objectives of simplifying the purchasing act, legal security and optimising expenditure. Thus, the Purchasing Centre acts as an intermediary under Article L.2113-2, 2° of the Public Procurement Code for any buyer established within the territory of the agglomeration and assumes, for this purpose, the responsibility for the conduct of the procedures and their legality. The list of members participating in the present consultation is attached in Annex 1 of the engagement act of the present contract. For the implementation of the object of this contract: • the purchasing centre, as coordinator, is the buyer responsible for the preparation, award, signature and notification of this contract and any associated amendments; • each Participating Member is responsible, for its part, for executing the contract for what concerns it. The Participating Members have decided to participate in a collective self-consumption operation extended in the sense of Article 1bis of the Decree of 21 November 2019 setting the geographical proximity criterion of the extended collective self-consumption meeting the following cumulative criteria: • one of the producers or consumers participating is a commune or an EPCI with its own taxation; • all producers and consumers participating are public or private bodies exercising a public service mission or local mixed-economy companies mentioned in Article L. 1522-1 of the CGCT and their subsidiaries; • the withdrawal and injection points are located exclusively within the geographical scope of the public establishment of intercommunal cooperation with its own taxation participating in the project or to which the commune or communes participating in the project adhere; • by way of derogation, the cumulative power of the production facilities of the projects meeting the cumulative criteria of this derogation is less than 10MW. The present contract concerns the supply of renewable electricity to the delivery points of the Participating Members, including the following services: • the non-exclusive supply of renewable electricity to the delivery points of the Participating Members; • the management and certification of the capacity guarantees and origin guarantees associated with these productions; • the role of balance responsible associated with the injections of electricity from the production asset(s) in accordance with Article L. 321-15 of the Energy Code; • the conditions for injecting, into the public distribution network operated by the Distribution System Operator (DSO) Enedis, electricity produced by the Producer of the production asset(s). The present contract takes effect from its notification to the Contracting Producer and until 31 December 2047. The present consultation follows a first unsuccessful procedure, no offer was received.
