The subject of the contract is the provision of ticket and travel document inspection services in trains operated by Warszawska Kolej Dojazdowa sp. z o.o.

The detailed description of the subject of the contract is set out in Annex 2 to the SWZ, in which the Contracting Authority has defined the maximum scope of the contract, subject to the reservation of clause 3.

The Contracting Authority reserves the right to exercise the Option Right: 1) The Contracting Authority indicates that the minimum scope of the contract, hereinafter referred to as the basic scope, relates to the implementation of the contract, as mentioned above in clause 1 of the SWZ and the Description of the Subject of the Contract, constituting Annex 2 to the SWZ, for a period of 12 months from the date of commencement of the service; 2) The Contracting Authority indicates that the option right, hereinafter referred to as the "Option Right", covers the implementation of the contract, as mentioned above in clause 1 of the SWZ and the Description of the Subject of the Contract, constituting Annex 2 to the SWZ, for the next 12 months following the basic scope.

The Option Right will be exercised subject to the Contracting Authority having financial means secured. The condition for the exercise of the Option Right is the delivery by the Contracting Authority to the Contractor of a statement of will regarding the exercise of the Option Right in the scope specified by the Contracting Authority. The Contracting Authority will submit a declaration of the exercise of the Option Right 6 months after the commencement of the implementation of the basic contract.

In the event that the Contracting Authority does not exercise the Option Right, no claims shall accrue to the Contractor on this account. The Contracting Authority reserves the right to not be obliged to exercise the Option Right.

The Contractor is obliged to implement the contract on the principles and conditions described in the draft contractual provisions (PPU) constituting Annex 4 to the SWZ.

The Contracting Authority does not divide the contract into parts and does not allow for the submission of partial tenders.

The main subject of the contract in this Procedure is a service within the meaning of art. 7 point 28 of the Pzp.
