Delivery of vegetables and fruits group I, divided into 6 parts. Part 1: Delivery of vegetables - Toruń Part 2: Delivery of fruits group I - Toruń Part 3: Delivery of vegetables - Inowrocław Part 4: Delivery of fruits group I - Inowrocław Part 5: Delivery of vegetables - Popiołowa Droga 1, Toruń Part 6: Delivery of fruits group I - Popiołowa Droga 1, Toruń

In accordance with Article 57 of the Pzp Act, Contractors who may apply for the award of the contract are those who:

1.1. are not excluded

1.2. meet the participation requirements:

1.2.1. capacity to operate in the economic market; The Contracting Authority does not set conditions in this respect

1.2.2. entitlements to carry out a specified economic or professional activity, if this results from separate provisions;

1.2.2.1. The Contractor has a registered economic activity in the field of production, storage, packaging and trade in agricultural food products, to the voivodeship inspector of the commercial quality of agricultural food products - Act of 21.12.2000 on the commercial quality of agricultural food products if the law imposes an obligation to have such entitlements (Dz.U.z2023 r., poz. 1980)

1.2.2.2. The Contractor has been authorized to produce or trade in foodstuffs - Act of 25 August 2006 on food and feed safety - and has a current decision or certificate issued by the competent authority of the official food control - if the law imposes an obligation to have such entitlements

1.2.3. economic or financial situation; - The Contracting Authority does not set a condition in this respect

1.2.4. technical or professional capacity: The Contractor will meet the condition if it demonstrates that in the last 3 years before the deadline for submitting offers, and if the period of carrying out the activity is shorter - in this period, it has carried out or is carrying out the delivery of vegetables or fruits of group I, which is the subject of the contract, provided to one Recipient within one contract, in an uninterrupted period of at least 6 months, for individual parts: Part 1 - of a value not less than 50 000zł Part 2 - of a value not less than 20 000zł Part 3 - of a value not less than 40 000zł Part 4 - of a value not less than 15 000zł Part 5 - of a value not less than 100 000zł Part 6 - of a value not less than 30 000zł confirmed by evidence that it has been (is being) properly carried out. If the Contractor submits an offer for more than one part of the subject matter of the procedure, it is obliged to demonstrate the performance / implementation of the above deliveries to one recipient, within one contract for the highest of the amounts specified as a condition for participation in the procedure required for the parts for which the offer is submitted (list of deliveries along with references)

Subject matter evidence for parts no. 1, 2, 3, 4, 5, 6: In order to confirm that the offered deliveries meet the requirements and features specified by the Contracting Authority, the Contracting Authority requires the submission of the following subject matter evidence with the offer: HACCP system certificate issued by companies with accreditations and authorisations of the Polish Centre for Accreditation based in Warsaw or a national accreditation organisation for the given country or a certificate of the competent authority of the State Sanitary Inspection on the supervision of the application of the implemented HACCP system; or a certificate of the competent authority of the State Veterinary Inspection on the supervision of the application of the implemented HACCP system, of the acquired goods 3. Subject matter evidence The Contractors are obliged to submit the following subject matter evidence with the offer. 4. If the Contractor has not submitted the subject matter evidence or the submitted subject matter evidence is incomplete, the Contracting Authority will call for their submission or completion. 5. The Contracting Authority envisages changes to the contract and the detailed scope of these changes will be included in the draft provisions of the contract. 6. Contractors who are not excluded on the basis of the exclusion grounds from Article 5k of Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014), in its current wording and from Article 7(1) of the Act on special solutions in the field of counteracting support for aggression on Ukraine and serving to protect national security submitted on the basis of Article 125(1) of the Act of 11.09.2019 Public Procurement Law may apply for the award of the contract. 7. A currently valid decision of the Military Veterinary Inspector ordering the commanders of military units and institutions to cease procurement from the given Contractor may not be issued against the Contractor applying for the contract. 8. The offer must include the following documents and declarations - Completed and signed with a qualified electronic signature, the offer-price form drawn up on the basis of the template constituting - Annex No 2 to SWZ; - Declaration by the Contractor of not being excluded from the procedure on the basis of Article 5k of Council Regulation (EU) 833/2014 in the wording given by Regulation 2022/576 (OJ L 111, 8.4.2022, p. 1) along with the Declaration, regarding the exclusion grounds under Article 7(1) of the Act on special solutions in the field of counteracting support for aggression on Ukraine. The template for the declaration is Annex No 5 to SWZ; - Subject matter evidence - Power of attorney – if applicable - Third party commitment – if applicable - Declaration of Contractors jointly applying for the award of the contract, from which it follows which services are performed by individual Contractors – if applicable - Document confirming the appointment by the Contractors jointly applying for the award of the contract of a representative to represent them in the procedure for the award of the contract – if applicable Declaration of Contractors on providing resources – if applicable 9. Subject evidence - in accordance with the list in Chapter IX SWZ. After evaluating the offers, the Contracting Authority will call the Contractor, whose offer has been evaluated as the most advantageous, to submit the current declarations or documents within the specified period, not shorter than 10 days, as of the date of submission.
