The procedure is conducted in accordance with the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the PPA. The procedure is conducted in the form of an open tender in accordance with Article 132 of the PPA. The Contracting Authority awards the contract in parts, each of which is the subject of a separate procedure. The subject of the contract is the supply of bread, bakery products and pastries. Common Procurement Vocabulary (CPV) codes: 15811000 – 6 Bread, 15612500 – 6 Bakery products, 15811100 – 7 Bread, 15812200 – 5 Cakes, 15812100 – 4 Pastry products. The detailed description of the subject of the contract is specified in the annexes no. 1, 1.1 - 1.2, 5.1 - 5.2 and no. 4 to the SWZ, i.e.: Offer Form, Assortment and Price Specifications, Descriptions of the Subject of the Contract and Draft Contract Clauses. The Contracting Authority allows the submission of partial offers, each of which will be evaluated by the Contracting Authority separately, according to the rules described in the SWZ. The contract has been divided into parts, in accordance with the description contained in annexes no. 1.1 - 1.2 to the SWZ. Each of the Contractors may submit an offer for any chosen part/parts. The Contracting Authority requires an offer to be submitted for all required positions listed in annexes no. 1.1 - 1.2 to the SWZ. In this procedure, the Contracting Authority intends to award a basic (guaranteed) contract and possible contracts under the Right of Option. Information on the scope of the contract covered by the Right of Option, including the scope, the deadline for the Contracting Authority to exercise this right and the rules under which it will be exercised, is described in annex no. 4 to the SWZ. The Right of Option is a right of the Contracting Authority, which it may, but does not have to, exercise within the framework of this procedure. The Contracting Authority does not incur any liability for not issuing such a request to the Contractor, and the Contractors are not entitled to any claim for the Contracting Authority not exercising the Right of Option. The circumstances of exercising the option are described in § 3 of annex no. 4 to the SWZ. Whenever in this SWZ the subject of the contract is described with reference to trademarks, patents or origin, source or a particular process that characterizes the products supplied by a specific Contractor, if this could lead to the favouring or elimination of certain contractors or products, it is assumed that such references are accompanied by the words "or equivalent". In describing the subject of the contract, the Contracting Authority, on the basis of the provision expressed in Article 99(4) of the PPA, indicated a trademark or origin due to the specificity of the subject of the contract and the impossibility of describing it exhaustively by means of precise and understandable terms. By describing the subject of the contract using trademarks, patents or origin, source or a particular process that characterizes the products, the Contracting Authority thereby defines the quality, technical and user parameters to which the subject of the contract must comply in order to meet the requirements set by the Contracting Authority. The subject of the contract should meet the technical, functional and quality parameters specified by the Contracting Authority in the description of the subject of the contract, which is annex no. 5.1 – 5.2 to the SWZ. The Contracting Authority does not exclude the possibility of applying for the award of the contract exclusively by Contractors referred to in Article 94(1) of the PPA, i.e. having the status of a protected employment establishment, social cooperatives and other Contractors, the main aim or main aim of the activity of their organizationally separate units, which will implement the contract, is the social and professional integration of socially marginalised persons.
