Czechia – Legal services – Specializované právní služby v oblasti investiční výstavby ŘVC ČR na období 2026–2030

The subject of the Framework Agreement is, in accordance with the provisions of § 131 and subsequent ZZVZ, the arrangement of conditions for the provision of legal services between the selected supplier and the contracting authority for the duration of the Framework Agreement (hereinafter also “legal services”), as well as the arrangement of conditions on the basis of which partial public contracts will be awarded between the contracting authority and the selected supplier according to the current needs of the contracting authority. Partial public contracts will be awarded through implementing contracts (hereinafter also “Implementing Contract”). Implementing Contracts will be concluded in accordance with the provisions of § 134 para. 1 ZZVZ, i.e. by a procedure without the renewal of the tender, where the more detailed conditions for the conclusion of Implementing Contracts are set out in Article 2 of the Framework Agreement. The legal services will relate to the area of the Client's investment construction and will consist in the application of, in particular, the following legal regulations: -Act No. 114/1992 Coll., on the Protection of Nature and Landscape, -Act No. 114/1995 Coll., on Inland Navigation, -Act No. 100/2001 Coll., on the Assessment of the Effects on the Environment, -Act No. 254/2001 Coll., on Waters and on the Amendment of Certain Acts (Water Act), -Act No. 416/2009 Coll., on the Acceleration of the Construction of Transport, Water and Energy Infrastructure, -Act No. 283/2021 Coll., the Building Act. The legal services will consist in particular in the following activities necessary for the performance of activities within the entire scope of the contracting authority's activities: i. providing expert consultations and advice, ii. preparing legal analyses, opinions and reviews, iii. drafting and reviewing methodologies and internal regulations, iv. drafting and reviewing contractual documentation and other legal documents, v. representing the contracting authority in negotiations with public authorities, vi. representing the contracting authority in negotiations with third parties. The legal services will not consist in the drafting of contracts relating to the management and administration of property (purchase, donation, exchange, transfer, lease, loan, establishment of servitude, etc.).
