With this tender, the Contracting Authority wishes to conclude a framework agreement with a professional, reliable and conscientious funeral organisation for the execution of municipal funerals. The Contractor must be able to act quickly, conscientiously and in accordance with the law and regulations after the order has been placed. The desired situation is that municipal funerals are carried out in a uniform, sober and respectful manner. In doing so, the human dignity of the deceased is central, while at the same time account is taken of the public nature of the Contract and the need for cost control. This contract involves the guarantee of the Decree on the Disposal of the Dead of the municipality of Apeldoorn and concerns a framework agreement with an estimated value of €1.600.000,-. The mentioned amount is an indication, therefore no rights can be derived from the mentioned amount. The contract value over the total duration of the framework agreement will be maximised at 150% of the amount mentioned above under ‘Contract Scope’. This results in a maximum contract value excl. VAT of this tender of €2.400.000,-. Once this value is reached, the framework agreement may only be used according to the provisions of Articles 2.163a to 2.163g of the Public Procurement Act 2012. If it is no longer possible to invoke these provisions, the framework agreement will cease to have effect and the municipality will no longer be able to use it, regardless of the remaining term of the framework agreement. In that case – if the maximum value has been reached or this will be exceeded very soon - the framework agreement will be terminated by the municipality with the Contractor with a notice period of one month. This termination does not give rise to a right to compensation from the municipality to the Contractor.
