1. Subject of the procurement: supply and distribution of electrical energy for a period of 24 months to buildings and points of electricity consumption of the National Institute of Public Health – National Research Institute (hereinafter “NIZP PZH – PIB”), within the scope of two locations, namely at ul. Chocimska 24 and ul. Powsińska 61/63 in Warsaw, in accordance with the Act of 10 April 1997 on Energy Law (consolidated text Journal of Laws 2026, item 43) [hereinafter “Energy Law”] and the executive acts issued thereunder. The subject of the procurement is detailed in the Subject of Procurement Description, which is Chapter III of the SWZ. 2. The contracting authority envisages the granting of an option right. The contracting authority envisages an option right in the subject procurement. a) The contracting authority envisages the possibility of increasing the supply of electrical energy or increasing the maximum value of the Contract by applying the option right; b) The option right amounts to a maximum of 20% of the amount specified in §8, paragraph 7 of the Draft Contract Terms and Conditions. c) The contracting authority makes the possibility of exercising the option right conditional on: 1) the addition of new points of electricity consumption (hereinafter “PPE”) or 2) the increase in demand for the supply of electrical energy in the already existing PPE or 3) the increase in the costs of implementing the contract related to the supply or distribution of energy. d) The settlement of the increase in demand for the supply of electrical energy in the existing PPE or/and additional points of consumption will take place in accordance with the basic part of the procurement and at the same settlement rate. e) The contracting authority is not obliged to exercise the option right. f) In the event that the contracting authority does not exercise the option right, the contractor is not entitled to any claims in this regard. g) The condition for the activation of the option right is the contracting authority's declaration of intent to perform the procurement within the framework of the option right and the submission of the appropriate written order specifying the scope/value of the option right granted.
