The procedure is conducted in accordance with the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the Pzp Act. The procedure is conducted in the form of an unrestricted tender in accordance with Article 132 of the Pzp Act. The Purchaser awards the contract in parts, each of which is the subject of a separate procedure. The subject of the contract is the supply of pickled vegetable preserves. Common Procurement Vocabulary (CPV) Code: 15331000-7 Processed Vegetables. The detailed description of the subject of the contract is specified in Annexes No. 1, 1.1, 5 and No. 4 to the SWZ, i.e.: Tender Form, Assortment Price Specification, Description of Contract Items and Draft Contract Clauses. The Purchaser does not accept partial tenders. Reason: The Purchaser does not accept partial tenders, as the subject of the contract covers successive deliveries of pickled vegetable preserves, which require ensuring the continuity of deliveries, a uniform level of quality, and efficient organisation and coordination of the implementation of the contract. Dividing the contract into parts and entrusting their implementation to several contractors could hinder the current coordination of deliveries, especially in terms of deadlines, quantities, and the quality of the delivered products. In the event of shortages, delays, or the need to exchange products, additional coordination of actions between the Purchaser and individual Contractors would be necessary, which could negatively affect the continuity of supply. Furthermore, deliveries made by different Contractors could be associated with differences in quality and the manner of delivery, which would make it difficult to ensure the uniform standards required by the Purchaser. Dividing the contract could also result in increased organisational and logistical costs, related to, among others, servicing several contracts, coordinating multiple deliveries, and controlling their proper implementation. For the above reasons, the Purchaser considers that the implementation of the entire contract by one Contractor will ensure a more efficient organisation of deliveries, greater continuity and predictability of supply, and a uniform quality standard of the delivered pickled vegetable preserves, and will also help to limit the costs and risks associated with coordinating cooperation with many Contractors. The Purchaser requires the submission of a tender for all the required positions listed in Annex No. 1.1 to the SWZ. The Purchaser envisages in this procedure the award of a basic (guaranteed) contract and possible contracts within the framework of the Right of Option. Information on the scope of the contract covered by the Right of Option, including the scope, the deadline for the Purchaser to exercise this right, and the rules under which it will be exercised, is described in Annex No. 4 to the SWZ. The Right of Option is a right of the Purchaser, which it may, but is not obliged to, exercise within the framework of this procedure. The Purchaser is not liable for any failure to direct such a request to the Contractor, and the Contractors have no claim for the Purchaser's failure to exercise the Right of Option. The circumstances of exercising the option are described in § 3 of Annex No. 4 to the SWZ. Whenever in this SWZ the subject of the contract is described with reference to trademarks, patents, or origin, source, or a special process that characterises the products supplied by a particular Contractor, if this could lead to the favouring or elimination of certain Contractors or products, it is assumed that such references are accompanied by the words "or equivalent". In describing the subject of the contract, on the basis of the provision expressed in Article 99(4) of the Pzp Act, the Purchaser has indicated a trademark or origin due to the specificity of the subject of the contract and the impossibility of describing it exhaustively using precise and understandable terms. By describing the subject of the contract using trademarks, patents, or origin, source, or a special process that characterises the products, the Purchaser thereby defines the quality, technical, and user characteristics that the subject of the contract must meet in order to meet the requirements set by the Purchaser. The subject of the contract should meet the technical, functional, and quality parameters specified by the Purchaser in the description of the subject of the contract, which is Annex No. 5 to the SWZ. The Purchaser does not reserve the possibility of applying for the award of the contract exclusively by Contractors referred to in Article 94(1) of the Pzp Act, i.e. those having the status of a protected employment establishment, social cooperatives, and other Contractors, the main goal or main goal of the activity of their organisationally separate units, which will implement the contract, is the social and professional integration of socially marginalised persons.
