The Contracting Authority informs that in the current public procurement procedure, it also acts through an agent, namely the Law Office Drembkowski & Partners sp.k. with its registered office in Warsaw, ul. Grzybowska 87, 00-844 Warsaw, NIP: 9512443024, REGON: 368021646, authorized to act on behalf of and for the benefit of the Contracting Authority within the scope resulting from the granted power of attorney. The assignment of the Office to perform tasks in the procedure is made within the framework of auxiliary procurement activities, as referred to in Article 37(2-4) of the Public Procurement Law. Within the scope covered by the power of attorney, the Office may perform tasks related to the preparation or conduct of the procedure, in particular formal, organizational and correspondence tasks, including preparing draft tender documents, conducting correspondence with contractors, providing or forwarding explanations of the tender, preparing invitations, notifications, information and other documents related to the procedure, as well as performing other tasks provided for in the tender documents and the power of attorney. The agent's actions do not change the status of the Contracting Authority in the procedure. The Contracting Authority remains the Gmina Miasto Świnoujście, which bears the responsibility for the preparation and conduct of the procedure in accordance with the provisions of the Public Procurement Law. The actions taken by the agent within the scope of the granted authorization are carried out on behalf of and for the benefit of the Contracting Authority. All communication with contractors, including the submission of offers, declarations, documents, requests for clarification of the tender, notifications and other information, is carried out in accordance with the rules set out in this tender, in particular through the procurement platform indicated in the tender. The indication of the agent does not establish a separate channel of communication with contractors, unless the Contracting Authority explicitly decides otherwise in the tender or in the information placed on the website of the conducted procedure.

2.1. In the procedure, communication between the Contracting Authority and contractors is conducted through the platform for the management of tender procedures, available at: www.platformazakupowa.pl/um_swinoujscie (hereinafter referred to as the “Platform”).

2.2. The Contracting Authority also allows the possibility of submitting electronic documents, declarations or electronic copies of documents or declarations by e-mail to the address: [email protected].

2.3. In all correspondence related to this procedure, the Contracting Authority and the Contractors use the procedure number.

2.4. Registration on the Platform, including the submission of an offer, requires the creation of a user account. In order to create a user account, the user must have an active e-mail account.

2.5. The technical and organizational requirements for using the Platform are set out in the Platform's regulations (available at: https://platformazakupowa.pl/strona/1-regulamin) and the instructions for contractors (available at: https://platformazakupowa.pl/strona/45-instrukcje). A contractor participating in the public procurement procedure accepts the terms of use of the Platform, as set out in the Regulations, and acknowledges them as binding.

2.6. The manner of preparing documents or declarations must be in accordance with the requirements specified in the Public Procurement Law, the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on the subject matter of documentary evidence and other documents or declarations that the Contracting Authority may require from the contractor (Journal of Laws of 2020, item 2415, as amended) and the Regulation of the President of the Council of Ministers of 30 December 2020 on the manner of preparing and transmitting information and technical requirements for electronic documents and electronic communication means in a public procurement procedure or a competition (Journal of Laws of 2020, item 2452).

2.7. The Contracting Authority does not foresee any other means of communication with the Contractors than by using the electronic communication means indicated in the tender.

2.8. In substantive matters related to this procedure, the Contracting Authority provides for the possibility of communication solely by electronic means, by using the “Messages” button on the Platform.

2.9. In technical matters related to the operation of the Platform, the Client Support Centre should be used, which will provide all information related to the process of submitting offers, registration or other technical aspects of the Platform. The Client Support Centre is available from Monday to Friday from 7.00 to 17.00 at tel. 22 101 02 02.

2.10. In emergency situations, for example in the event of the Platform being unavailable, the Contracting Authority may also communicate with the Contractors by e-mail.

2.11. The procedure is conducted in Polish, which means that all correspondence, documents, declarations, etc. submitted during the procedure between the Contracting Authority and the contractors must be drawn up in Polish.

2.12. The Contracting Authority does not foresee the convening of a meeting of contractors.

3. The minimum technical requirements for using the Platform are: the internet browser EDGE, Chrome and FireFox in the latest available version, with JavaScript support enabled, accepting “cookies” files and an internet connection with a bandwidth of at least 256 kbit/s. The Platform is optimized for a minimum screen resolution of 1024x768 pixels.
