Tender Procedure by means of the European open procedure in accordance with the (amended) Public Procurement Act 2012. Contracting Authority The contracting authority for this tender is the Municipality of Breda. For more information about the Municipality of Breda, please refer to the municipality's website: www.breda.nl. Contract One of the municipality's tasks is parking enforcement. The Municipality of Breda carries out this enforcement in-house. Since 2019, scan cars have been used for this purpose. Parking fines are issued. These fines need to be collected. This request concerns the imposition and collection of the parking fines issued by the municipality for both Dutch and foreign license plates. Furthermore, objections can be made against these fines. The processing of these objection letters and the processing of any subsequent appeals also form part of this contract. For indication, the figures for 2024 are given below. The following numbers of NHAs are involved: Dutch license plates: 110,000 Belgian license plates: 11,000 German license plates: 1,500 other countries' license plates: 5,000 27,755 objections per year 88 appeals per year The indication of the expected numbers is based on the current situation. It is emphasized that the scope is an indication to which no rights can be derived. The actual scope of the contract may therefore deviate positively or negatively from the given indication. Regular reporting on the activities carried out is also part of the scope. The municipality expects the party to be contracted to keep up with new developments and changes in legislation and regulations. This party, for example, communicates proactively when collection in multiple/new countries becomes possible. The party to be contracted sends the NHAs, the design of which is developed in cooperation with the municipality, including that the NHAs issued refer to the executing party for the objection possibilities, this must be clearly indicated in text and by means of a QR code. The municipality ensures that its website refers to the objection possibilities with the contractor. The municipality is looking for a party that can guarantee fast and efficient handling of the collection files and objection cases, with customer friendliness being a top priority. Knowing that no one is 'happy' with a fine, it is precisely in the customer contacts that a customer-friendly and, if necessary, de-escalating approach is important for the municipality. The Municipality of Breda is currently working on developing a wheel clamp policy. The municipality is currently in the first exploratory phase. It is possible that more information about the introduction of the wheel clamp policy will be available during the contract or just before the contract is finalised. Parcels This contract is not divided into parcels: Objective The objective of this tender is to conclude a framework agreement for the provision of these services. The agreement comes into effect after signing and has a term of two (2) years from the date of live start on 1 February 2027. The contracting authority has the right, with the mutual consent of the parties, to extend this two (2) times by one (1) year. The decision-making regarding this/these extension(s) is based on an evaluation of the performance delivered. Maximum Contract Value The maximum contract value within the framework of this framework agreement is set at €995,000, including extension options. No rights can be derived from the mentioned amount. There is no obligation for the contracting authority to purchase. If the maximum contract value is exceeded during the term of the framework agreement, the framework agreement will be terminated (earlier).
