The subject of this order is the supply of medical materials. The detailed description of the subject of the order is defined in Annex No. 2 to the Specification of Order Conditions. The subject of the order is free from physical and legal defects, factory new, previously unused by third parties, in particular, it has not been used as a demonstration item and is of good quality. It has also not been previously reconditioned. The medical products offered, which are the subject of the order, must meet the requirements specified in the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2024, item 1620). The labelling of the delivered materials, user instructions, and product descriptions must be prepared in Polish. The Contractor undertakes to execute the subject of the order in accordance with all the requirements of the Ordering Party indicated in the SWZ. The Contractor is obliged to submit an offer for the whole of the given, selected by him, part or parts, taking into account all the positions of the given part. All the requirements specified in the order documents are minimum requirements, and their fulfillment is obligatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the order conditions on the basis of Article 226(1)(5) of the Pzp Act. If the Ordering Party, in the description of the subject of the order, indicates trademarks, patents or origin, sources or a special process that characterizes the products or services supplied by a specific Contractor, equivalent solutions to those described may be offered, provided that they maintain the same minimum technical, quality and functional parameters. In the event that the description of the subject of the order contains references to standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp Act, the Ordering Party allows equivalent solutions to those described. The Contractor who refers to equivalent solutions is obliged to prove that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor attaches to the offer a list of equivalent solutions together with its description or standards.
