Poland – Refuse and waste related services – Świadczenie usługi odbierania odpadów komunalnych i zagospodarowania tych odpadów od właścicieli nieruchomości, na których zamieszkują mieszkańcy, powstałych na terenie Gminy Konopiska

4.1 The subject of the contract is "The provision of the service of collecting and disposing of municipal waste from property owners, where residents live, generated within the territory of the Gmina Konopiska". 4.2 The subject of the contract is the collection and disposal of municipal waste generated and collected on all properties, where residents live, located within the administrative boundaries of the Gmina Konopiska. The contract includes the collection and disposal of the entire stream of municipal waste handed over by the owners of properties located in the above-mentioned municipality, where residents live, in a manner that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods, as well as the reduction of the mass of biodegradable municipal waste handed over for disposal as part of the assigned task. The detailed description of the subject of the contract (OPZ) is contained in attachment no. 1a to SWZ. 4.3 The basic obligations of the Contractor include: 1) collecting and disposing of the entire stream of municipal waste handed over by the owners of properties located in the Gmina Konopiska, where residents live, in accordance with the collection schedule approved by the Contracting Authority, 2) handling waste in a manner consistent with the principles of waste management set out in the Act of 14 December 2012 on waste, environmental protection requirements and the Waste Management Plan for the Śląskie Voivodeship, 3) striving, in accordance with art. 3b para. 1 and art. 3c para. 1 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities and executive regulations to the above-mentioned Act, to achieve the set levels of recycling, preparation for reuse, recovery by other methods and reduction of the mass of biodegradable municipal waste handed over for disposal as part of the assigned task, 4) using specialist vehicles and ensuring a sufficient number of such vehicles, guaranteeing the timely and high-quality performance of the scope of the service, 5) having a system for monitoring the location of vehicles and ensuring the Contracting Authority has unlimited access to this system, 6) enabling representatives of the Contracting Authority to carry out comprehensive control of the manner in which the service is performed by the Contractor, 7) timely submission of monthly reports and statements required from the Contractor in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, 8) equipping waste collection points in multi-family buildings with the necessary containers for collection and property owners with the necessary bags, 9) disposing of the collected waste by transferring it for recovery or disposal in accordance with the provisions of the applicable law. Mixed municipal waste (code 20 03 01) should be transferred to the municipal waste processing installations indicated in the offer by the Contractor. In the event of transfer of the above waste to substitute installations, the Contractor is obliged to submit a document confirming the refusal to accept waste by the municipal installations. The document should be submitted together with the waste transfer notes. 10) Submitting a monthly report on the implementation of the service: • delivery of waste transfer notes, in accordance with the Regulation of the Minister of the Environment of 2 January 2020 on the waste catalogue, • providing information on the quantity, size and location (property address) of emptied containers with mixed waste (code 20 03 01), • providing information on the quantity, size, type and location (property address) of collected bags and emptied containers with segregated waste, • providing information on the mass (Mg) and type (waste code and name) of waste collected from properties, • providing information on the mass (Mg) and type (waste code and name) of waste collected from the selective collection point for municipal waste, • providing information on the quantity of individual types of bags for the selective collection of municipal waste collected, 11) submitting reports on the implementation of the service, relating to the mass of municipal waste collected from property owners, pursuant to art. 9n of the Act on maintaining cleanliness and order in municipalities, 12) submitting by 31 January following the end of the calendar year a document containing detailed calculations of the achieved levels of: • recycling and preparation for reuse of the following fractions of municipal waste: paper, metals, plastics and glass, • recycling, preparation for reuse and recovery by other methods of non-hazardous construction and demolition waste constituting municipal waste, • reduction of the mass of biodegradable municipal waste handed over for disposal.
