Design services for the consolidation, restoration, fencing, landscaping, enhancement and re-functionalisation of the Rosetti-Balș Manor Ensemble - Balș in the Cultural Centre of the Rosetti-Balș Manor Ensemble (VS-II-a-A-06870) with the following components: Rosetti-Balș Manor LMI VS-II-M-A-06870.02, Fountain LMI VS-II-M-B-06870.03 and Secondary Building LMI VS-II-M-B-06870.04, included in the National Restoration Programme, approved by the Ministry of Culture, as the main budget allocator and implemented by the National Institute of Heritage, the body managing the funds allocated to the research, expert assessment and execution of the consolidation-restoration and enhancement works of historic monuments. The award procedure is initiated under the present suspensive clause, in the sense that the Contracting Authority reserves the right to condition the signing of the contract on the allocation of the budget credits by the main budget allocator - the Ministry of Culture - but no later than 6 months from the completion of the award procedure, respectively the designation of the winner. In the event that, although the necessary legal steps have been initiated, the main budget allocator does not allocate the necessary budget funds, within 6 months from the completion of the award procedure, respectively the designation of the winner, the award procedure will be cancelled in accordance with art. 212, para. (1), lit. c) of Law no. 98/2016 on public procurement, corroborated with the provisions of the Order of the Minister of Public Finance no. 1792/2002 and Law no. 500/2002 on public finances. Bidders within this award procedure understand that the contracting authority cannot be considered responsible for any damage in the event of cancellation of the award procedure, regardless of the nature of the damage and regardless of whether the contracting authority has been notified of the existence of such damage. Bidders within this award procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any damages they may suffer in the described situation.

SERVICE PROVISION PERIOD

Stage I Documentation for the approval of the intervention works (DALI), will be a maximum of 4 months from the signing of the contract.

Stage II Project for the authorisation of the construction works – DTAC, in accordance with HG no. 907/2016, respectively DTAD, if applicable, the Project for the Organisation of the Execution of the Works (DTOE) will be a maximum of 1 month from the approval of DALI in CTE constituted at the level of INP and/or MC, as the case may be.

Stage III Restoration project of the artistic components, Technical Execution Project (PT) and execution details (DE), will be a maximum of 2 months from obtaining the Building Permit.

The contract enters into force on the date of signature by both parties and runs until the fulfilment of all contractual obligations, the service provision period being 7 months, excluding approval periods.
