Poland – Solar photovoltaic modules – Zakup, montaż i włączenie do sieci magazynu energii

The subject of the contract is implemented within the framework of a targeted grant awarded by the Voivode of Łódź to the Radomszczanski District for the financing of own tasks carried out within the framework of the OLiOC program, the executor of which is a territorial self-government unit and/or another executor indicated by the territorial self-government unit.

1. The subject of the contract is: Purchase, installation and connection to the grid of an energy storage system. The contractor undertakes to design, supply and implement, including commissioning, an integrated energy storage system with the contracting authority's existing electrical installation, in accordance with the requirements specified in the Specifications of the Contract (hereinafter SWZ), in particular the Description of the Subject of the Contract contained in the SWZ.

2. The subject of the contract is described using design documentation, which includes: 1) Technical specification for the execution and acceptance of works – Annex No. 7 to SWZ 2) BUILDING DESIGN Construction of a photovoltaic installation with a capacity of up to 1 MW as part of the task "PV installations and energy storage for the Radomszczanski District Hospital" – Annex No. 10 to SWZ TOM I Land development project TOM II Architectural and building design TOM III Building design annexes 3) Decision No. 625/2025 of 28 October 2025 for the construction permit for 6 modular wind turbines and a photovoltaic installation with a capacity of up to 1 MW as part of the task 'PV installation and energy storage for the Radomszczanski District Hospital' – Annex No. 11 SWZ

3. The scope of work and the contractor's obligations are detailed in Annex No. 2 to SWZ – contract project.

4. Justification for the reasons for not dividing the contract into parts: The subject of the contract is the supply of an energy storage system, and the execution of this supply must be preceded by changes to the design documentation held by the contracting authority and obtaining a decision changing the existing building permit so that the documentation corresponds to the energy storage system offered by the contractor and the description contained in the description of the subject of the contract (OPZ) prepared by the contracting authority. This requires the contractor of the energy storage system supply task to be commissioned to carry out auxiliary design activities. The construction works also have only an auxiliary character, are related to a specific device, which is to be supplied by the energy storage system supplier, and do not have an independent character. Additionally, the contracting authority has one deadline for the implementation of the entire task, which also justifies the commissioning of the entire contract to one contractor. Obtaining one quality guarantee for the entire task strengthens the protection of the contracting authority.

5. 6. All the requirements specified in the documents indicated above constitute minimum requirements, and their fulfillment is obligatory. Failure to meet the above minimum requirements will result in the rejection of the tender as non-compliant with the contract conditions pursuant to art. 226 para. 1 point 5 of the Pzp.

7. In cases where, each time, the documentation indicates the names of building products, materials and devices as well as any formulations that may indicate a specific manufacturer, it should be borne in mind that they have been used for the purposes of preparing the documentation. The parameter values in the documentation should be treated as the minimum required by the contracting authority. They indicate the minimum quality of the product, durability, safety, physical characteristics and functionality parameters and are not absolutely binding (equivalent solutions described in Annex No. 7 to SWZ – technical specification are permitted). Equivalent solutions may not be inferior to those specified in the design documentation. Proposing equivalent solutions is permitted provided that they guarantee the achievement for the subject of the contract of overall operational and functional parameters not inferior to those assumed in the design and technical documentation, which means achieving identical or better values.
