Description

The subject of the contract is the conclusion of framework agreements for the provision of accommodation and catering services for police officers. 2. A detailed description of the subject of the contract is provided in Section XIX of the SWZ and Annex No. 6 to the SWZ. 3. The Contracting Authority does not require the submission of subject-related evidentiary means with the offer in any task. 4. The Contracting Authority allows the assignment of part of the contract to a Subcontractor. 5. The Contracting Authority requires the Contractor to indicate in the offer the part of the contract which will be assigned to Subcontractors, and to provide the names of any potential Subcontractors, if known. 6. Requirements regarding employment under an employment contract in the circumstances referred to in Article 95 of the Act: 1) The Contracting Authority requires the Contractor or Subcontractor to employ, under an employment contract, persons performing the following tasks within the scope of the contract: meal preparation. 2) During the implementation of the contract, the Contracting Authority is entitled to carry out control activities with regard to the Contractor to ensure that the Contractor or Subcontractor meets the requirement to employ, under an employment contract, persons performing the tasks indicated in subparagraph 1. In order to verify compliance with these requirements, the Contracting Authority is entitled, in particular, to request: a) a declaration from the employed worker, b) a declaration from the contractor or subcontractor regarding the employment of a worker under an employment contract, c) a copy of the employment contract of the employed worker, certified as being in accordance with the original, d) other documents - containing information, including personal data, necessary to verify employment under an employment contract, in particular the name and surname of the employed worker, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker's duties; 3) The Contractor shall submit to the Contracting Authority, upon each request from the Contracting Authority, within the time limit specified in that request, the evidence indicated in point 2 in order to confirm compliance with the requirement to employ, under an employment contract, by the Contractor or Subcontractor, persons performing the tasks listed in point 1. The Contracting Authority specifies the sanctions for non-compliance with these requirements in Section XIX of the SWZ. 4) In the event of justified doubts regarding compliance with labour law by the Contractor or Subcontractor, the Contracting Authority may request an inspection by the State Labour Inspectorate. 7. The Contracting Authority reserves the right to conduct a local inspection and check the hotels/hotel facilities of the Contractors, whose offers will be the highest rated in terms of meeting the requirements of the facility in relation to the requirements set out in the SWZ. In the event that the facility does not meet the requirements described in the SWZ or the Contractor does not make the facility available for inspection by the Contracting Authority, the Contracting Authority will reject the Contractor's offer on the basis of Article 226(1)(5) of the Act: "The Contracting Authority shall reject an offer if: its content is inconsistent with the conditions of the contract". 8. The procedure for awarding contracts based on framework agreements is described in Section XIX of the SWZ. 9. The purpose of this procedure is for the Contracting Authority to conclude framework agreements (in each task) with a maximum of 5 (five) Contractors, whose offer prices do not exceed the amount that the Contracting Authority can allocate to finance the framework agreement and achieve positions from 1 to 5 in the offer evaluation criteria, unless fewer Contractors submit non-rejectable offers. 10. The type and scope of changes to the agreement are indicated in Section XIX of the SWZ. 11. The Contractor is bound by the offer for 90 days from the expiry of the offer submission deadline, with the first day of binding by the offer being the day on which the offer submission deadline expires, i.e. until 30.12.2026. 12. The subject contract may be tendered by Contractors who are not excluded on the basis of Article 108(1) and (2) of the Act, Article 109(1)(1) and (4), (7), (8), and (10) of the Act, and Article 7(1) of the Act of 13 April 2022 on specific solutions to counter the support for aggression against Ukraine and serving to protect national security (i.e. Dz. U. from 2025 item 514) and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1) as amended, hereinafter: Regulation 833/2014, in the wording given by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 111 of 8.4.2022 p. 1) and amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine. 13. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the "GDPR", the Contracting Authority informs that: 1) the administrator of your personal data is the Warsaw Police Commander; 2) supervision over the proper processing of personal data is carried out by the data protection inspector: address: ul.
