Poland – Diesel oil – „Dostawa oleju napędowego w ramach bezobsługowego systemu zarządzania gospodarką paliwową w roku 2027”
Description
The subject of the contract is the delivery of up to 380 m3 of diesel fuel, in successive batches throughout 2027, within the framework of an unattended diesel fuel dispensing system with the possibility of managing deliveries and refueling, as well as usage analytics (fuel management system - SZGP). 2. The contract includes two types of contracts, namely services or supplies, given that the main subject of the contract in terms of cost is the supply of diesel fuel, the provisions relating to supplies shall apply to its award. 3. Task name: Delivery of diesel fuel within the unattended fuel management system in 2027. 4. Task description: In order to precisely specify the subject of the contract, the Purchaser divides its description into 3 segments: 1) Preparation of a comprehensive system for fuel management based on the infrastructure owned by the Purchaser, i.e. a dispenser for unattended diesel fuel dispensing and an underground diesel fuel tank; 2) Successive delivery of diesel fuel from the date of commissioning the unattended fuel management system until 31.12.2027; deliveries will be made silently, i.e. based on the analytics conducted within the fuel management system commissioned by the Contractor; 3) Current servicing of the tank and dispenser of the Purchaser (including fuel stock status analytics) in order to ensure the continuity of fuel dispensing. The Purchaser intends to provide vehicle identifiers and driver identifiers/cards in accordance with the system requirements. The cards must enable recognition of the driver and vehicle in the system and must be programmed on the device. The Purchaser specifies that it envisages covering approximately 105 vehicles and 100 drivers with the system. Diesel fuel delivery parameters: a) The diesel fuel should meet the parameters specified in the current Norm PN-EN 590 on the date of submission of the offer and the Regulation of the Minister of Climate and Environment on the quality requirements for liquid fuels of 26 June 2024 (i.e. Journal of Laws of 2024, item 1018 as amended). The Purchaser envisages the delivery of standard diesel fuel throughout the contract period, with the reservation, however, that during the winter period (1 December – 28 February) it reserves the right to order diesel fuel with improved low-temperature properties (so-called Arctic), the availability of which the Contractor should guarantee during the above-mentioned winter period. The above reservation does not impose an obligation on the Purchaser to order Arctic diesel, the above provision is intended solely to ensure the departure of vehicles for winter road maintenance or waste collection in the event of extremely low temperatures. The principle is that standard diesel fuel will be delivered during the contract period (with the reservation of the provisions of clause 6a in fine regarding changes in the type of diesel fuel delivered during the contract). Diesel fuel should have the parameters indicated in Annexes 6a and 6b. The above conditions relate to each delivery of diesel fuel during the contract period. b) In order to confirm the parameters of the diesel fuel for each partial delivery, the Contractor will provide a quality document for the given batch of fuel, in particular an original or certified copy of the quality certificate, a sealed sample of fuel marked with the date of the specific delivery, a waybill issued by the warehouse (tax warehouse) containing the date and time of loading, the registration number of the tanker delivering the fuel and the surname of the driver carrying out the loading of the tanker. The delivery of diesel fuel may not take place later than 24 hours from the moment of loading the tanker at the warehouse (tax warehouse). The sample must be taken from the delivered batch of fuel and in the presence of a Purchaser's employee. The arbitral sample will be stored with the Purchaser. In the event of a quality dispute, the Purchaser will be entitled to lodge a complaint with the Contractor and to have the sample tested in a laboratory indicated by the Contractor. In the event of failure to meet the quality requirements of the fuel specified in this contract, the cost of such testing will be borne in full by the Contractor. Detailed agreements regarding the procedure for taking, storing and testing the arbitral sample will be made at the stage of signing the contract, by jointly signing the relevant agreement after familiarisation with the procedure for testing the arbitral sample proposed by the Contractor.
