The procedure is conducted in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the PPA. The Contracting Authority awards the contract in parts, each of which is the subject of a separate procedure. The public procurement procedure aims to conclude a framework agreement. The framework agreement is awarded through an unrestricted tender pursuant to Article 311(1)(1) in conjunction with Article 132 of the Act of 11 September 2019 – Public Procurement Act (Journal of Laws of 2026, item 793). The procedure is conducted to conclude a framework agreement with one Contractor, in accordance with the provisions of Article 313(1) of the PPA. The Contracting Authority envisages the possibility of a single renewal in parts I and II of the contract for a further 24 months. The renewal involves the implementation of the same service (with the same material scope) under the same conditions specified in the contract, and requires the agreement of both the Contracting Authority and the Contractor (does not require the conclusion of an annex to the contract). The value of the single renewal is "imposed from above", being identical to the value of the basic contract and is calculated on the basis of the indicated unit prices. The detailed description of the subject of the contract is specified in Annexes No. 1, 1.1 - 1.2. and No. 4 to the SWZ, i.e. the Offer Form together with the Product-Assortment Price Specification and the Draft Contract Terms. The estimated scope together with the quantities of the subject of the contract is specified in Annex No. 1.1. – 1.2. of the SWZ, prepared on the basis of the expected, estimated needs (operational-maintenance) for the years 2026, 2027 and 2028. The Contracting Authority does not have knowledge of the exact quantities, type and time of implementation of its needs, which are to be satisfied in the future. The Contracting Authority reserves the right to order supplies of the assortment in quantities smaller or larger than the estimated quantities indicated in Annexes 1.1 – 1.2. of the SWZ, depending on the actual needs, with the proviso that the total value of the Contractor's remuneration for the implementation of the contract may not exceed the remuneration value specified in the contract. The Contracting Authority allows for the submission of partial offers, each of which will be evaluated by the Contracting Authority separately, according to the rules described in the SWZ. The contract has been divided into parts, in accordance with the description contained in Annexes No. 1.1. – 1.2. to the SWZ. Each Contractor may submit an offer for any chosen part/parts. The Contracting Authority requires an offer to be submitted for all the required items listed in Annexes No. 1.1. – 1.2. to the SWZ. Whenever in this SWZ the subject of the contract is described with reference to trademarks, patents or origin, source or a particular process that characterizes the products supplied by a specific Contractor, if this could lead to the favouring or elimination of some contractors or products, it is assumed that such indications are accompanied by the words "or equivalent". In describing the subject of the contract, based on the provision expressed in Article 99(4) of the PPA, the Contracting Authority has indicated a trademark or origin due to the specificity of the subject of the contract and the lack of possibility of its exhaustive description by means of precise and understandable terms. By describing the subject of the contract using trademarks, patents or origin, source or a particular process that characterizes the products supplied, the Contracting Authority thereby determines the quality, technical and user characteristics that the subject of the contract must meet in order to meet the requirements set by the Contracting Authority.
