2. PROCEDURE FOR AWARDING THE CONTRACT 2.1. The procedure is conducted as an unrestricted tender in accordance with the provisions of the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793 with later amendments; hereinafter: PZP) and the implementing acts to the PZP. 2.2. The procedure is conducted in accordance with the rules provided for classical contracts of a value equal to or higher than the amounts specified in the announcement of the President of the Public Procurement Office issued under Article 3(2) of the PZP. 2.3. The procedure will be conducted in accordance with the rules provided for the so-called "reverse order of tender evaluation", as referred to in Article 139 of the PZP. According to the aforementioned provisions, the Contracting Authority will first carry out an examination and evaluation of the tenders, and then carry out a subjective qualification of the Contractor whose tender was highest rated, in terms of the grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 3. DEFINITIONS Whenever in the present SWZ reference is made to: a) PZP - this shall mean the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793 with later amendments), b) Directive 2014/24/EU – this shall mean Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (Official Journal of the European Union L series of 2014, No 94, page 65 with later amendments) c) contract - this shall mean the public contract to which the present SWZ relates, d) procedure - this shall mean the procedure for awarding the contract, e) Contracting Authority – this shall mean the Contracting Authorities listed in Section 1, Part I of the SWZ, f) working day - this shall mean a day which is not a day recognised by law as a non-working day or a Saturday, g) price – this shall mean the price in the meaning of Article 3(1)(1) and (2) of the Act of 9 May 2014 on the disclosure of prices of goods and services (i.e. Journal of Laws of 2023, item 168), even if it is paid to a person who is not an entrepreneur, h) Contractor – this shall mean a natural person, a legal person or an organisational unit without legal personality, which offers on the market the performance of construction works or a construction object, the supply of products or the provision of services or applies for the award of a contract, has submitted a tender or has concluded a contract for a public contract, i) consortium – this shall mean Contractors jointly applying for the award of a contract, j) SWZ, specification – this shall mean the present specification of the contract conditions, k) single document/SED (Single European Document) – this shall mean a declaration submitted on the form of the single European document, drawn up in accordance with the standard form specified in the Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the single European document, l) qualified electronic signature - a signature issued by a qualified trust service provider being a subject providing certification services and based on a qualified electronic signature certificate. The electronic signature must meet the security requirements specified in the Act of 5 September 2016 on trust services and electronic identification (i.e. Journal of Laws of 2024, item 1725) and Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (Official Journal of the European Union L series of 2014, No 257, page 73 with later amendments; eIDAS Regulation); m) tender – this shall mean the Tender Form submitted in electronic form together with the remaining documents required in the procedure documentation, meeting the provisions of Article 78(1)(1) of the Civil Code of 23 April 1964 (i.e. Journal of Laws of 2026, item 795) (c.c.) and Article 66(1) c.c. in conjunction with Article 8(1) and Article 63(1) and Article 218(2) of the PZP, n) partial tender - this shall mean a tender providing, in accordance with the contract documents, for the performance of part of the contract; o) subjective evidence means - this shall mean means serving to confirm the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure, with the exception of SED, PROJECTED CONTRACT TERMS - Chapter 22 of the SWZ EMPLOYMENT REQUIREMENTS - Chapter 24 of the SWZ OTHER INFORMATION - Chapter 25 of the SWZ INFORMATION OBLIGATION - Chapter 26 of the SWZ 4. DESCRIPTION OF THE CONTRACT 4.1. The subject of the contract is: comprehensive provision of a service related to the acceptance and management of municipal waste, entitled “Management of municipal waste from uninhabited properties in the area of the Municipality of Środa Wielkopolska in 2027”. 4.2.
