Description

1. The subject of the contract is the supply of electricity, as defined in the Act of 10 April 1997 on Energy Law (i.e. Journal of Laws 2026.43), hereinafter referred to as the supply of active electrical energy, in the total estimated amount, for the duration of the contract, approx. 12,350.00 MWh. 2. The Contractor must have, by the date of commencement of the contract execution on the date of signing the contract, concluded agreements or a promise of an agreement for the provision of electricity distribution services with the distribution system operators: PGE DYSTRYBUCJA S.A., PKP Energetyka Spółka Akcyjna, ESV6 Sp. z o.o., STOEN OPERATOR Sp. z o.o. and ENERGA Operator S.A. The Contractor's declaration that it has a current agreement or a promise of an agreement with the relevant Distribution System Operator (DSO) enabling the sale of electricity through the DSO's distribution network to the Contracting Authority's sites will be a condition for signing the public procurement contract. 3. The Contracting Authority reserves the right to reduce the number of energy intake points indicated in Annex 1a to the SWZ in the event of changes in ownership of the right to administer, changes in the method of use or closure of individual energy intake points. 4. The Contracting Authority, in accordance with Article 441 of the Act, provides for the possibility of exercising the right of option. The Contracting Authority indicates that the right of option includes the possibility of increasing the scope of the basic contract in terms of purchasing electricity, with the maximum scope of the right of option being: • up to 15% of the value of the basic contract specified in § 4 para. 1 of the contract template, • up to 15% of the forecasted volume of electricity specified for the basic contract. The right of option may be exercised in full or in part, depending on the actual needs of the Contracting Authority. The Contracting Authority will inform the Contractor of its intention to exercise the right of option with the appropriate notice. The exercise of the right of option will be carried out in accordance with the terms set out in the contract, with the application of the unit prices of electricity resulting from the Contractor's offer. The Contracting Authority is not obliged to exercise the right of option, and the Contractor has no claim to its implementation. In the event that new electricity intake points not indicated in this SWZ arise during the contract execution, the Contracting Authority reserves the right to exercise the right of option and order the supply of electricity to these new points at the prices that the Contractor has specified in its offer. The supply of electricity covered by the right of option may not exceed 15% of the basic scope of the contract subject. 5. The sale of electricity should be in accordance with the provisions of the Energy Law and the executive regulations to this Act. 6. A detailed description of the scope of the contract subject is contained in the annexes to the SWZ. 7. The Contracting Authority does not envisage the award of contracts referred to in Article 214(1)(8) of the Pzp, i.e. those involving the repetition of similar supplies, constituting the basic contract subject.
