1. The procedure is conducted as a restricted procedure in the fields of defence and security, in accordance with Article 410(1) of the Public Procurement Law (Pzp). A restricted procedure, in accordance with Article 140 of the Pzp, is a method of awarding a contract in which, in response to a contract notice, all interested contractors may submit applications for admission to the procedure, but only contractors invited to submit tenders may submit tenders. 2. As a result of this procedure, a framework agreement will be concluded, on the basis of which implementation contracts will be concluded in accordance with Article 422 of the Pzp, in accordance with the procedure specified in the draft provisions of the framework agreement. 3. Contractors bear all costs related to the preparation and submission of a tender. Contractors undertake not to claim any rights in this regard against the Purchaser. The Purchaser does not provide for the reimbursement of participation costs. 4. The Purchaser does not provide for the conduct of an electronic auction, as referred to in Article 227 of the Pzp. 5. The Purchaser may invalidate the contract award procedure before the deadline for tender submission if circumstances arise that make further conduct of the procedure unjustified. 6. The Purchaser provides for the possibility of invalidating the contract award procedure if the funds that the Purchaser intended to allocate for the financing of the whole or part of the contract are not granted to it.
