1. The procedure is conducted as a restricted procedure in the defence and security sectors, pursuant to Article 410(1) of the Public Procurement Law (Pzp). A restricted procedure, in accordance with Article 140 of the Pzp, is a method of awarding a contract in which, in response to a contract notice, all interested contractors may submit applications to participate in the procedure, but only invited contractors may submit tenders. 2. As a result of this procedure, a framework agreement will be concluded, pursuant to which specific contracts will be concluded in accordance with Article 422 of the Pzp, in accordance with the procedure specified in the draft provisions of the framework agreement. 3. Contractors bear all costs associated with the preparation and submission of a tender. Contractors undertake not to claim any rights in this regard against the Buyer. The Buyer does not envisage the reimbursement of the costs of participation in the procedure. 4. The Buyer does not envisage the conduct of an electronic auction, as referred to in Article 227 of the Pzp. 5. The Buyer may cancel the contract award procedure before the deadline for the submission of tenders if circumstances arise that make it unjustified to continue the procedure. 6. The Buyer envisages the possibility of cancelling the contract award procedure if the funds that the Buyer intended to allocate for the financing of the whole or part of the contract are not granted to it.
