The procurement concerns sampling and laboratory analyses of groundwater, wastewater, sludge, etc. and is carried out as a single public procurement for a single contract, and not as a framework agreement. The contracting authority commits to using the selected Supplier for the delivery of the procured services in the contract period in accordance with the contract's provisions. The contracting authority determines a sampling plan at the time of contract award. The sampling plan constitutes the fixed and known main delivery in the contract period. The sampling plan specifies the scope, types and frequency of analyses and forms the basis for the Supplier's planning and resource allocation. In addition, additional orders may occur to a limited extent, relating to the contracting authority's operation and supplementing the fixed sampling plan. Additional orders can only take place within the scope of the contract and must have a subordinate scope in relation to the fixed sampling plan. Teknisk Vand A/S' possible needs are covered by the contract, the need concerns sampling and environmental analyses within the scope of the contract. The need is expected to be able to arise in the contract's possible option period and can include wastewater-related analyses, documentation analyses, verification analyses, operational control, analyses as a result of regulatory requirements, as well as analyses of influent, process streams and the purified effluent from the treatment plant. The exact scope is uncertain at the time of procurement, and therefore no separate items for Teknisk Vand A/S have been included in the tender list. Any orders from Teknisk Vand A/S can only take place within the scope of the contract and within the contract's framework for additional orders. Analyses that are not listed in the tender list, but that are covered by the scope of the contract, are invoiced according to the Supplier's list prices with deduction of the offered discount rate. On this basis, there is a mutual and binding obligation between the parties. The contracting authority commits to accepting the services in accordance with the sampling plan and the contract's provisions, and the Supplier commits to delivering these services on the contract's terms in the contract period.
