Poland – Pharmaceutical products – 245/PN/2026 - Dostawa produktów leczniczych dla UCK

The subject of the contract is the supply of pharmaceutical products for UCK in the assortment, estimated quantity and requirements specified in Annex 3 to the SWZ. 2. The Purchaser allows the submission of partial offers. By partial offer, the Purchaser means individual parts determined in Annex 3 to the SWZ. The Contractor may submit an offer for one or more parts. 3. In the scope of Part 1, the Purchaser allows the submission of partial offers. By partial offer, the Purchaser means individual items determined in Part 1 in Annex 3 to the SWZ. The Contractor may submit an offer for one or more items. 4. For the items marked in the assortment-price form with the symbol (**) in Annex 3 to the SWZ, the Purchaser requires that the offered preparation is in the catalogue of refunded drugs used in drug programmes or in the catalogue of refunded drugs used in chemotherapy. 5. The Purchaser has specified the packaging method in the assortment-price form. In items where there is no such description, the Contractor may offer any packaging method while maintaining the quantity required by the Purchaser specified in the given item. The Contractor must price the proposed packaging method with the appropriate conversion. 6. Deliveries will follow successively, in quantity and assortment, according to the Purchaser's partial orders within 2 days from the date of the order. The ordered assortment the Contractor is obligated to deliver at their own expense to the Hospital Pharmacy. 7. The Purchaser requires that the prices of the offered drugs are not higher than the official prices, specified in Article 9(1) and (2) of the Act of 12.05.2011 on the reimbursement of drugs, special dietary foods and medical devices (Dz.U. 2025 poz. 907), valid on the date of submission of offers – if applicable. 8. The offered pharmaceutical products must be in accordance with the Act of 6 September 2001 on Pharmaceutical Law (Dz.U. 2025 poz. 750) – if applicable. The offered pharmaceutical products must be allowed to be sold in Poland under the conditions specified in Article 3 or 4a of the Pharmaceutical Law. 9. The offered medical devices must be in accordance with the Act of 7 April 2022 on Medical Devices (Dz. U. z 2024 r. poz. 1620) as well as in the executive acts issued on the basis of this Act – if applicable. 10. The Purchaser allows the submission of an equivalent offer in the scope of Part 1 items 24, 28, 45, 46, 132, 135, 136, 137. The Purchaser informs that all trade names used in the description of the subject of the contract specify the required standard of the ordered assortment. The Purchaser allows the submission of offers with equivalent quality parameters, having an identical chemical composition in the scope of the main substances. The proof of meeting the condition of equivalence lies with the Contractor. 11. In cases where the Purchaser used in the description of the subject of the contract designations of standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp, equivalent solutions are allowed. Each time a standard is indicated in this SWZ or in the annexes to the SWZ, it should be assumed that the formulation “or equivalent” has been used in relation to it. In cases where the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems, as referred to in (1)(2) and (3), the Purchaser may not reject an offer solely because the offered supplies are not in accordance with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject of the contract refers, provided that the Contractor proves in the offer, in particular by means of the subject-matter evidence referred to in Articles 104-107, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 12. The Purchaser requires the submission of offers in electronic form. A detailed description (instructions) for submitting offers in electronic form is contained in Section XIV of the SWZ. The Purchaser informs that in the present procedure for awarding a public contract, the so-called "reverse order of evaluation of offers" as referred to in Article 139 of the PZP will be applied. By applying the above procedure, the Purchaser will first examine and evaluate the offers, and then qualify the Contractor whose offer was the highest rated in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 14. The Contractor may entrust the execution of part of the contract to a subcontractor. 15. The Purchaser does not allow the submission of variant offers. 16.
