The subject of the contract is the successive delivery of orthopedic procedure materials – cemented single-compartment knee joint endoprosthesis along with the creation of a deposit and the use of a drive. The detailed description of the subject of the contract is contained in the Price Form - Annex No. 2 to SWZ. Each Contractor may submit only one offer for the entire contract in written form, under pain of invalidity. In the event that a Contractor submits more than one offer for the entire contract, all offers of that Contractor will be rejected by the Purchaser. The Purchaser reserves the right to ensure that the offered subject of the contract must belong to the group of medical devices within the meaning of the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2024, item 1620 as amended) and the Regulation of the European Parliament and of the Council (EU) 2017/745 of 5 April 2017 on medical devices, amending Directive 2001/83/EC, Regulation (EC) No 178/2002 and Regulation (EC) No 1223/2009 and repealing Council Directives 90/385/EEC and 93/42/EEC. The offered subject of the contract must have all the necessary permits for use in healthcare facilities in accordance with Polish law and European Union law. The subject of the contract offered by the Contractor must have a CE marking and valid documents allowing for admission to trade on the territory of the Republic of Poland and use in accordance with the provisions of the Act of 7 April 2022 on medical devices, including in particular a Certificate issued by a notified body and Declarations of Conformity.
