Description

The subject of the contract is the current, annual maintenance of cleanliness and greenery in urban areas from 1 November 2026 to 31 October 2028. The summer period covers the months from April to October, and the winter period covers the months from November to March. 2. The contract has been divided into four geographically distinct parts: Part I of the contract – maintenance of cleanliness in urban green areas in the Koźle settlement area, Part II of the contract – maintenance of cleanliness in urban green areas in the Śródmieście, Pogorzelec and Kłodnica settlements, Part III of the contract – maintenance of cleanliness in urban green areas in the Azoty, Wschód, Cisowa and Sławięcice settlements, Part IV of the contract – maintenance of cleanliness in urban green areas in the Blachownia settlement 3. Emergency duty The Contractor provides emergency duty on weekdays from 15:00 to 21:00, and on statutory holidays from 8:00 to 21:00. The time to start implementing the emergency report is – according to the offer – up to 60, 90, 120 or 150 minutes from the effective transmission of the report. Commencement means the physical arrival of persons sent by the Contractor to the indicated place and the actual commencement of actions aimed at eliminating the irregularity. 4. Right of option and change in scope of maintenance of areas 1) The Purchaser provides for, within the right of option, an increase in the scope of the contract covering: a) the inclusion in the maintenance of additional areas within the scope of summer maintenance requiring current maintenance of cleanliness, one-time mowing, maintenance of lawns, removal of waste and contaminants, raking and removal of leaves, removal of weeds, self-seeding and overgrowth, maintenance of alleys, walkways, squares, approaches and hardened surfaces in clean condition, emptying and cleaning bins and maintenance of typical small architecture elements located on this area, b) the inclusion in the maintenance of additional areas within the scope of winter maintenance requiring current maintenance of cleanliness, removal of waste, contaminants, leaves and branches, emptying and cleaning bins, maintenance of alleys, walkways, squares, approaches and hardened surfaces in clean condition, snow removal, removal of snow, slush and ice, combating slipperiness, removal of material causing roughness and contaminants arising in connection with winter maintenance and cleaning of typical small architecture elements located on this area, if the weather conditions permit, c) the ordering of additional mowing of selected surfaces within the areas covered by the basic contract or areas included in the maintenance within the right of option. 2) Additional areas may be included in the maintenance, corresponding in character, method of development and scope of maintenance to the areas covered by the basic contract. 3) The right of option does not cover the inclusion of areas requiring a different method or standard of maintenance than that specified in the contract documents, in particular new playgrounds, national memorial sites, sports facilities, greenhouses, stages, fountains, slopes requiring specialist equipment, extensive hardened surfaces or areas equipped with a significant number of small architecture elements requiring separate maintenance. 4) The exercise of the right of option takes place by transmitting to the Contractor a statement from the Purchaser in documentary form 5) Services covered by the right of option are settled according to the prices specified in Annex A/B/C/D to the tender form, on the basis specified in § 7 and § 10 PPU. 6) Detailed provisions regarding the right of option are specified in § 2, 7, 10 PPU 7) The Purchaser provides for the possibility of excluding areas or parts of areas covered by the basic contract or previously included in the maintenance within the right of option increasing the scope of the contract. 8) The total area of areas simultaneously excluded from maintenance may not exceed 200 ar, subject to point 9. 9) The limit referred to in point 8 does not apply in the case of temporary exclusion from maintenance of a district or its part, if the exclusion is caused by the conduct of investment, repair, construction work, reconstruction, revitalisation, change in the organisation of land use or other works making it impossible or pointless to perform the services in this district or its part. 10) In the case referred to in point 9, the exclusion may cover the entire area of the given district indicated in the list of areas applicable to the given part of the contract. 11) Regardless of the provisions of points 8-10, the guaranteed level of service provided is at least 80% of the remuneration indicated in § 7 para. 1 in PPU 5. Employment requirement. Pursuant to 95 para. 1 of the Pzp Act, the Purchaser requires the Contractor or Subcontractor to employ, under an employment contract, persons performing the following activities related to the implementation of the contract: - tidying work in maintaining cleanliness and maintenance work in maintaining urban greenery. The method of verifying employment, the Purchaser's entitlements in the scope of control and the penalties for non-compliance with the requirements are specified in the Draft Contract Terms. 6. The detailed description of the subject of the contract specifies, inter alia, point 3 SWZ, Rules for maintaining the cleanliness of urban green areas applicable to the given part of the contract, Draft Contract Terms along with annexes placed in electronic version on the website of the conducted procedure constitute an integral part of the SWZ.
