The quantities presented in Annex 4 to the SWZ are estimated quantities, calculated based on the historical consumption to date, in order to determine the value of the contract. The Contracting Authority guarantees that the minimum total consumption will not be less than 60% of the volume indicated in Annex 4 to the SWZ. 3) The sale of energy will take place through the distribution network owned by the local Distribution System Operator (DSO). The Contracting Authority requires that the Contractor executing the contract has, by the date of conclusion of the sales contract at the latest, a valid contract with the DSO, on the basis of which it is possible to carry out the sale of electrical energy through the distribution network of that DSO to all of the Contracting Authority's facilities indicated in Annex 4 to the SWZ. 4) Settlements for the delivered electrical energy will be made on the basis of the readings of the metering and settlement systems according to the unit prices for the given point of intake based on the actual consumption of energy and will be increased by the value of a fixed component payable monthly, specified in the price offer of the Contractor (commercial fee). 5) The Contracting Authority has the legal title to dispose of the facilities described in Annex 4 to the SWZ. 6) The Contracting Authority requires that the settlement period is consistent with the settlement period of the DSO. 7) The Contracting Authority will conclude one sales contract covering all of the Contracting Authority's points of intake. 8) The Contracting Authority allows the conclusion of a comprehensive contract for sale and distribution. 9) The Contracting Authority allows the possibility of signing the contract by correspondence or in electronic form (using an electronic signature). 10) The Contractor will conclude, on behalf of the Contracting Authority, a contract for the provision of distribution services in the case of points of intake for which comprehensive contracts applied so far and in the case of points of intake for which the distribution contract was concluded for a specified period. The Contracting Authority has provided the time necessary to conclude a distribution contract for points of intake of energy, for which the distribution contract is not concluded for an indefinite period. 11) The Contracting Authority has not concluded any promotional contracts or annexes. 12) The purchased energy will be used exclusively for own needs. The Contracting Authority declares that it is a final consumer within the meaning of the provisions of the Act of 6 December 2008 on excise duty (Journal of Laws of 2026, item 412 as amended). 13) The Contracting Authority has the status of a producer, as referred to in Article 2(39) of the Act of 20 February 2015 on renewable energy sources (Journal of Laws of 2026, item 68 as amended). 14) The rules for the buyback of excess electrical energy are specified in Annex 2b – Tender Form – Buyback and Annex 3 – Contract Template. 15) The Contracting Authority envisages the possibility of reducing the number of points of intake of electrical energy, as referred to in Annex 4 to the SWZ, while maintaining a 30-day notice period. 16) The Contractor is obliged to execute the contract on the terms and conditions described in the contract template constituting Annex 3 to the SWZ.
